Hi Im New On Here And Realy Need Help Fast
Story So Far
My Husband Took Out A Log Book Loan In Oct 08 (hard Times)
The Payments Would Coome Out Of The Bank By Standing Order Every Week But We Had The 1st 4 Weeks To Pay By Book At The Bank Till The Order Was Set Up This Is What We Did
The Standing Order Was Never Set Up I Made Some More Payments In The Bank And Contacted The Company Loads Of Times Then We Recived A Letter From Them Last Week For Reposetion I Contacted Them Again And Told Them I Now Did Internet Banking And Would Set The Standing Order Up Myself And Could I Pay The Normal Weekly Payment Plus £20 A Week And That Was Fine As I Set The Order Up I Had 2 Wait 3-4 Working Days For The 1st Payment To Come Out So They Agreed That Fri Coming Would Be The 1st Payment There Thought It Was All Sorted
That Was Untill Yesterday When We Recived Another Letter That They Charged Us £100 For Repossesion Fee £318.52 Repo Agents Fee And £5.00 For A Sms Message
I Phoned Them Again Told Them About The Agreement I Had And As It Was In My Husband Name They Couldnt Talk To Me But Nothing Would Be Done Till Fri With In The Hour I Had My Husbands Boss On The Phone And Ther Were 2 Men There 2 Remove The Car Unless I Payed Them £1300
My Dad Went Down And Offered A Payment They Refused The Payment And Because His Car Was Parked Behind Our Car They Called The Police Saying That Trouble Had Started (what A Lie My Dads A Sick Man At The Moment So There Is No Chance Of That)3 Police Cars Turned Up Within 35 Seconds And Couldnt Undersatnd Why They Had Been Called Out.
When The Recovery Truck Came 2 Take The Car He Was Handed The Keys And Told Us Cos He Had The Keys He Would Only Charge A Call Out Fee But Was Told By The 2 Men Who Came For The Car He Had To Also Cahrge For Recovey Bringing The £1300 Up To Just Under £2000
What Can I Do Can They Charge The Amounts They Do Can I Go 2 My Local County Court And Ask For A Hearing

I think you need to consult a solicitor immediately. Some will let you have a free first consultation. Failing that, try the CAB. Log Book loans companies are well known for their bully tactics, but usually operate just within the law.

Incidentally, I hope you don't mind me saying, but your post would be much easier to read if it was not in italics with all the words beginning with an upper case letter.

I know it doesn't help you now, but these people are nasty, nasty, nasty. They never wanted you to pay on time, it has always been their intention to take the car to sell at auction, which is why they have made it difficult for you to make your payments on time.

If you have a look on the Consumer Action Group website there's a whole forum dedicated to problems with Log Book Loans, and people there who will be able to give you great advice.
