Sickness and Annual Leave. HELP do i lose out

Hi All.

Il try and keep a long story short.

Ok i was off work on long term sick and have now went back to work this week. When i went in monday i ask was there anything i need to know are be told about and my manager said NO. But Today i found out off a workmate that we have to use all are holaday time by the 01/04/09. I went and ask what i had lift to take and its 4 weeks leave so there is no hope i can take that by the 01/04/09. So seen i was off on sick leave long term and could not book hol time off does that mean i lose them??

Can anyone help with info what i need to know is

Do i lose my hols seen i was off sick and am only back this week?

Or

Do they have to let me take them even if it runs over this cut off date?

Or

Do they have to pay them out seen there is 4 weeks to take and only two weeks to cut of date?

Like its a minths pay i dont want to lose out on them

can anyone help

    At the company I work for, if you are off sick and it goes over the holiday year (which for us is Jan 1st to dec 31st) then you loose the holidays. We have several people in our department that this has happened to, they were off sick for a few months before xmas and only returned to work in jan. they have lost what holidays they had left for the holiday year. I think this is the same throughout the UK. Sorry ! If you had booked some days off holiday and then were off sick, in our company you can claim them back, but only in the same holiday year.

    I've read this article, and a similar one in an Accountancy journal with interest.

    However I'm still not clear on one point.....

    Does this ruling apply to ALL of the annual leave a person is entitled to according to their contract, or just the minimum statutory leave of 24 days pa?

    At our company people have tried (via a big union) to use this (see link above), but we've been told that until a test case has been to the European Court of law, they don't have to give the holidays back. So we have several people waiting to hear what happens.
