Arrears advice please..sorry if this has been asked before

Hi

I have just received my assessment letter from the CSA. NRP asked for an assessment on 2.9.08, its taken till now due to 'computer says no' and going to clerical for the case to be assessed. He stopped paying any maintenance 5 months ago.

Now after speaking to the case working dealing with this, I find that they are allowing him to pay the arrears of £785 over 18 months. The man earns over £400 net a week, his partner lives with him and works, his mortgage is less than mine (I know for fact as I viewed the house he ended up buying and know how much he had to borrow to get it), he doesn't have a car loan as he hasn't changed his car (I know the loan cleard 6 months after we split). How on gods name can the CSA just take his word for it that he cant afford to pay any more towards his arrears??? Is there anything I can do to question this. Case worker basically said he'd send an appeals form out but I wouldn't get anywhere with it as they have two years to get arrears back.

I am gutted and now completely deflated. Any suggestions anyone?

Dizzy

The CSA have internal guidelines (though are NOT law) to collect arrears within a 2 year period so if he is paying within that timeframe then I'm not sure you can do anything about it.

Frustrating I know for you, but try to hang on to the thought that at least he is paying them. Of course a lump sum payment would be a hell of a lot more useful than dribs and drabs but as he has agreed to their timescale I would doubt very much that they would take any kind of further action.
