Received a letter of a DCA today claiming i owed the DWP £400 for loans taken out in 2004. when i phoned the dwp and asked for proof of me getting these loans which i can't remember getting (i asked for a breakdown and proof of my signature to say i received them) they told me that they have no obligation to send out proof of me signing for loans only a breakdown of what they say i got. if they cannot prove i had these loans is the debt still recoverable??

You can't remember getting the loans or are you trying to conveniently forget?

I think I would remember taking out a £400 loan, even if it was 5 years ago.

If you genuinely didnt take these out then you better tell them, but don't play games with them - the government writes the rules in a way that everyone else has to abide but them

at the time i was out of work looking after my daughter, they reckon within a month there is about 10 loans varying from £10 - £110. none of which i remember getting. As far as i was aware i was given payments while they sorted out my new claim
