Hi i am after a bit of advice. My husband and i split up 6 months ago. For the past 4 months i have been paying the mortgage on my own which i can afford to do. However i know our mortgage company will not allow me to take his name of the mortgage as my income is quite low. My ex is happy for me and our two children to stay in the property and does not need to sell to buy somewhere new but when he does buy his own place he wants his name of the current mortgage. Im worried that then they will make us sell the house even though i can afford the repaymnets. How does it work.

Surely when you divorce you should be able to stay in the property as you have children, or be financed enough by him from the sale (eventually) to afford somewhere else?

Is your husband paying maintenance? Would the maintenance plus your income be enough for a mortgage in your name?

He can't be taken off the mortgage unless either you take the mortgage in your own (or with someone else's) name or you sell the house.
