    We had this same problem when partner's son came to live with us for a while. If you can get the ex PWC to confirm with CB that the child now lives with you, it shouldn't take that long.

    If they won't, I think there is a rule that says the current claimant can continue to receive CB up to 56 days after the child has left, if they deem it to be a temporary situation. Only then will the CB make a decision on who is the PWC.

  • my husband applied for child benefit just before xmas , within a week his x's cb claim was froze while they investigated, i think he got a letter beginning of feb saying he was entitled to it and he got the backpay from when the x's cb was stopped

    should def not take 12 weeks

    Did they say it will take 12 weeks, or it could take up to 12 weeks?

    I've never known it to take that long and thought maybe they quote 12 weeks to cover themselves in case of delays.

    when i changed parent status and claimed CB it took about 4 weeks. The CB office have to write to other parent to verify that you are now the full time carer, when this is done they will process you claim.Obviously if other parent lies its fraud. If you have any letter stating you are now PWC from the other parent worth sending them a copy (not original).

    It's right about being able to backdate the tax credits for 3 months but that's not the point - you need the money now obviously.

    OP, I would get yourself to the CAB tomorrow and if no joy there then get onto your MP.

    Remarkedly, despite all the filth that pollutes LG's mind, her memory prevails! But to correct her assertions, I didn't have to wait until I got custody/residence before claiming Child Benefit. The day after I moved out ( with the kids) I phoned Newcastle to tell them of the circumstances, and that very week I started to receive CB ... I couldn't believe how easy it was.

    Basically, chase them up, and get your CSA claim in promto ... because you'll need all the time you have to actually get money from them. BTW... thanks Loopy for bringing this thread to my attention.

    shimmershelly, your BIL's case is a little complex. The mother can argue the move is temporary, or possibly (if that silly) deny children moved. CB have to investigate to see who is the actual main carer. For your BIL that will possibly mean obtaining information from SS too over the move. It is worth chasing them.

    Once CB is in his name then he can claim csa from her - not sure if he can submit a claim yet.

    As SS are involved it's hard to say what would happen if she wanted the children back - much depends on SS decision and reasons for initial removal (they would be the best to advise BIL's case).
