Think the best thing for you to do with Npower is ask them for pre payment meters before it gets worse. I had them fitted and it was a big help knowing that i wasnt getting in more debt and was at the same time paying off my balance. Must say they changed them back when i asked with no problems

Had meters installed recently which is kind of a big weight off my mind! I pay an extra £6 for gas and £3 electric per week to pay off the debt. Gonna take a while but at least it is getting paid this way.

I also applied for an Anglian Water grant thing yesterday which I found out about through MSE. This site is a godsend! Hope they can help me out with both my water bills. That would be another huge weight off my mind.

The things I am majorly struggling with are my catalogue and credit card debts. Because I haven't paid them for a while the minimum payment on most of them this month is around the £200 mark! This really worried me as I simply don't have the cash to pay them, and the charges are phenomenal!!!

The strength of being under 5k in debt is that if any of these were to issue a ccj you could apply for an Administration Order, which is a really neat way to deal with your debts.

I don't think any of them will (give you a ccj) but knowing about them takes the sting out of the threats and harassment you will probably get when you default.

Thanx for the link fatbelly! The administration order sounds like a very good thing for me so now I kind of hope that I can get one at some point. At least all of the charges etc will be stopped and it would just be one payemtn a month to the court.

  • "If the accounts were opened before April 2007 and they did not get a signature, then the debt cannot be enforced in court and any payments you choose to make are voluntary"

Can I ask what happens if you find the contracts not been signed and it was after April 2007?

    Many thanks

If the account was opened after April 2007 then the Consumer Credit Act 2006 applies and there is no automatic unenforceability - the courts can exercise their discretion.
  • What happens if I opened a Littlewoods account before April 2007, didn't sign anything, arranged a payment plan recently and stupidly signed the thing and sent it back? Does it still apply???
  • Hi Struggling with debt

I don't know the answer to your last question but somethign really stuck out from your SOA. That is the car. It is chewing up a huge chunk of your money (almost £300) but your spend on ptrol isn't high to indicate that you use it loads. Could you use public transport instead?

The amounts for gas and electric are high too but I assume that these include arrears payments.

Fingers crossed for you and good luck for getting the grant.

It's unenforceable - there is no signed Consumer Credit Act agreement.

What was the 'thing' you signed? What did you agree to?

I think it was a credit agreement of some kind, but this was very recently. Definately didn't sign one when I opened the account in early 2007
  • Is there a template letter anywhere that I can send to ask for a copy of my origianl credit agreement? Which I know they cannot send me because I didn't sign it!
