What To Do Next

I have credit cards for which I sent off a cca request back in November 2008 - I then sent the Formal Notice letter at the begining of this year both for which I have had nothing back - Is there a template letter to ask for the accounts to be closed down? If not what do I do next? **please help**

  • I think it depends which year you took your cards out as to whether the CCA request does any good TBH.

    Not sure what you mean by 'to be closed down?'. The debt still exists, it won't get closed down, just means without the CCA it is harder for whichever creditor/DCA has your account(s) to potentially enforce it. And if I understand you correctly, you cannot get them closed down in that way anyway.

    What to do next? Nothing, really. It is always up to the DCA/creditor to produce what you requested, they know what their obligations are. But it's up to you of course what you do next. But, no, you can't ask for the accounts to be closed down. If they are with a DCA for example what should have happened is that the account should be returned back to the creditor. They don't always notify people of that but it will probably be sold to the next one in the chain. There are various letters somewhere for that eventually anyway.

  • Then, hypothetically, there is a good chance they will not have one. So, sit back and wait. As you may know they are supposed to cease collection activity until they produce one. If you get any further hassles in that direction then post here and someone will help with what to reply with.

    Erm, no. The debt still exists so that would be impossible.

    Incidentally, who are these cards with as you don't say? Would it be Barclaycard for example? Sometimes it helps to know which creditor you are dealing with you see. As to what they are now likely to do next. :)

  • one is barclaycard and the other cap one - is the only way to get rid of it totally to offer a full and final settlement? even if there is no cca?
  • It's one route to go down, but only if you've got the money, of course. And it would dispense your debt, of course. Whether it would remove anything off your credit file is questionable. As you may have read on MSE some have had to fight to get the defaults removed off their credit history even after !!!!!!. Also, you would need to do it formally otherwise you could find they accept it incorrectly, then months down the line another DCA shows up demanding the balance/remainder.
