wescott .....im so upset i cant sleep +

nearly 7 yrs ago, we moved, we forwarded our mail through royal mail for 3 months i think
it was at that time we thought we closed a bank account with the woolwich
apparently not
we have sifted through papers and found we still had 100. debt on our overdraft

we did not think it was still live then so didnt give new address
next door got a phonecall do we live next to them
were we from ......
i called up ..and they said you hada loan with barclays.... i said no but they insisted, so i checked and sure enough woolwich are now part of barclays.

help.... will i get interest accruing on this debt?

by moving i know it looksbad but i was soooooo ill and came to live near mum in law. can anyone please tell me before i die from lack of sleep will there be loads and loads of interest??

    Have you aknowledged, the fact that you may still owe the money ? . If not, and if it was over 6 years ago then it statute barred

  • thanks, i think though if you move house, you are to blame.
    i havent acknowledged it and i wont till i see bank statement from them , but i guess because i didnt give them my address im liable
    im not frightened of 100.00
    or 250 court costs
    but anything more will cancel out my sons school trip money

    does anyone know if i will be paying interest?????

    Also, try and establish that this debt is yours. Get the information of what is owed and why and what date, if they have not contacted you for 7 years (if someone else was at your old address the mail would have been returned and they would hae known you was not getting your mail) then you are not liable as they could have found you in that time.

    As they have said you owe money to Barclays and not The Woolwich then you want to ensure that this debt is yours. We have been chased by this company for money owing that was not ours - our surname was the same as the person they wanted and I guess they just gave up chasing the correct person and sent it to someone with the same name. Be careful, please do not just pay without knowing all the facts and what the debt is for and how old it is because it might not be what you think it is for.

    Also, there is no need whatsoever to cancel your son's school trip, pay it back at a rate that you can afford - even if that is £1 a month. If the debt is yours and you want to pay it (you may not legally have to so make sure of this) go over to the debt free wannabe board and they will help you work out what you can afford. Please do not worry, these companies send these letters to scare you, it takes a long time for it to even get near a court and that will not happen while you are making payment - even £1 a month. Please do not worry though. Read the board I mentioned there are template letters on that board and they tell you what you need to put in the letters to see what is owed and if it is statute barred what letter to send to the company. Go to the CAB if you need help in person but you should be able to deal with it yourself and there are step by step instructions on how on the debt free wannabe board.

    I agree with the others - don't panic, take care what you say because the debt might be statute barred if they have left it more than 6 years before chasing you, and get advice from national debtline, CAB or one of the charities like CCCS and Payplan. If you do have to pay the debt, Wescott will very probably accept a small monthly amount, or you could offer an amount less than the full amount chased in full & final settlement. Have a look at the debt free wannabee board - people there have loads of experience dealing with these kind of problems.
  • have just spoken againto wescot, they were very helpful. they gave me the ref number, i phoned barclays head office, indeed it was the woolwich account opened years ago and still live!! lol
    so no court charges very tiny interest for 7 years, total sum owed 190.00 got new bank details and all so ive got a 5th bank account lol.
    both barclays and wescott very helpful and sympathetic.
