Had 2 letter's from someone called Apex dated 12/3/09. Both informing me that Natwest have passed 2 of my debts over to them (apparently last week. These letters were the first I knew of it) . These letters informed me that unless I made arrangements to settle my accounts within 72 hours our agents may be asked to attend your premises.
This is the very last thing I want so, against all advise, I phoned them to explain I was in a DMP and that I would ask CCCS to forward details of my repayment plan.
I got a little hot under the collar cos I was told unless I made an immeadiate holding fee payment my case could be"moved on" although when I asked what that meant I was not given an answer. I told them that CCCS would make payment on 25th. They said that that would be too late.
I pointed out that 72 hours was not sufficent warning. They said it was ample time. I explained didn't even receive the letter until 72 hours was up.
Anyway, you get the gist. I am worried now cos I was asked whilst I was on the phone if I was threatening the person I was talking to and I said no. (I even asked who Apex were as I had never heard of them before) I'm worried that I may have made things worse for me.
When I finally managed to get hold of CCCS (their phone wa busy all morning otherwise would've phoned them first) they told me I had done the right thing by refusing to make any payment outside the DMP. But the long and short of this is I am very, very worried. The guy I spoke to was asking me all sorts of questions like what my assets were (I have none) and I am worried that this could turn out nasty for me (and as I said before in another thread the last thing I want is my father being worried by people turning up on his doorstep) . I have been paying DM for 3 years now without any real problems.
Sorry to go on but needed that off my chest

Hi
Don't speak to them again on the phone and let CCCS keep paying them. They are trying to bully you into paying. If someone does attend your property (it happened to me!), they have no legal rights so tell them to b*gger off or your'll call the police as they are trespassing.
I'm on a dmp with CCCS and had a similar thing happen to me. I only rang the DCA to tell them CCCS would send the paperwork to them and they would receive payment from them in due course. I got all the same hot air that you got, I just spouted back at them and the guy got all hot under the collar with me! I wrote to them to confirm everything and I've heard nothing more from them for a couple of months. The guy got really nasty with me at one point as they do not have my telephone number - I refused to give it to him and my mobile number and that I would deal in writing only. He then spouted that by law he had to have a contact number and I spouted back that by law they only need one method of contact for me...they have that, my address! Funny I've not received the same threats and bullying from them in writing!
What I am trying to say (amongst the waffle) is do not worry. Just keep paying them via CCCS and ignore their threats.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free
Mortgage free since 2014

OFT - Debt collection guidance
Where is says that:
Quote:
pressurising debtors to pay in full, in unreasonably large instalments, or to increase payments when they are unable to do so
is considered to be an unfair practice and maybe even an example of psychological harassment.
And that all visits must be by prior MUTUAL agreement and that debt collectors have no legal rights. If they did turn up, ask them to leave nicely and them advise them that you are calling the police. If you've have not made a mistake, you've made nothing0 -
Apex seem to deal with banks as we have 1 debt with them through the halifax. I had HSBC ask me similar Qs over a £52 overdraft. All I was ringing up was for them to make a note of my married surname.0
