Help regards to taken name of mortgage

Hi any help to the following scenario would be great.

My partner split with her ex partner (unmarried) approx a year ago. They have one 20 month old child and a house owned in both names. My partner and her child live in the property. He partner wishes to take his name off the mortgage but her income is insufficient for her to take on the mortgage on her own aswell as having a poor credit history. The house is in negative equity due them increaing the loan to pay for a car which he now has.
I am now living in the property with her, i too have a poor credit history.

Can he force her and the child out the house? Any ideas on alternatives to remortgage/transfer of equity? Would be good to know her rights in the house too.

Any info/advise would be very appreciated!!!

  • None of you will be able to remortgage whilst it's in negative equity - you'll need a chunk of savings to bring the Loan to Value ration down to the 90% or so that lenders will cover at the moment. And you'll need a good credit history.

    There's no equity to transfer, so at the moment he would be having to buy himself out of the house, rather than just walking away. In the same way, they'd need to sort out the finance for the car being on the mortgage if he has the car.

    Are mortgage payments being made at the moment? Who's paying those?

    Presumably there's a legal arrangement in place regarding maintenance payments for the child?
