Advice on arrears payments please

  • The max amount of time given by the csa is 2 years.Where they got the time scale from God only knows.They can also take 40% of your net earnings.They normally only use DOE for non payers,but this is not allways the case.Once a DOE is placed they are very hard to be removed even when the arrears are cleared.

  • The stated 2 year payment period is a timescale set by the CSA themselves- there is no legal requirement to arrange to pay off all your arrears within this period.At worst, they go through taking you to court to get a liability order, then take you to county court.If they get a liability order on you, get a form (I think its an n245),fill it in and return it to the court and say you want to be informed when/where the case is being heard.THE CSA WILL NOT TELL YOU THEMSELVES.They also usually arrange the liability order somewhere away from where you live.Then you can arrange your arrears repayment through the county court taking the setting of amounts out of the CSA's hands.Remember though, this is then legally binding on you to comply.

    Well i thought i'd give you guys an update regarding the story so far.

    I went to the complaints resolution department, who i stated my case to & they ignored me & went to my employer without consulting me.
    In the mean time i was paying the arrears off via Giro payment slips. and managed to get the arrears down to less than £100.

    They have now taken an overpayment of £160.00 & now are telling me that they cant pay me back. they are telling me although they have left me with no money for the rest of the month (i cant get to work because of the overpayment) the payment will take nearly 6 weeks to get to my acount so i might as well let them take it off my next payment.

    So the moral of this story people is the CSA can walk all over you & although they make blatant mistakes, they will never be held accountable for the outcomes. dont bother to complain becasue they just ignore you & your well being as a father does not concern them.
    I am now left with no way of eating for the rest of the month or actually getting to work.

    All i wanted to do was catch up on the arrears & they have just ignored this fact & now they are taking money that they have no right to & holding it because they can. i am waiting for a time slot with my HR manager to explain to her that i dont know if i can get to work for the rest of the month......worried that i may loose my job over this.
