hiya,
bit of background info:
my OH pays csa for his 2 children who live with there mother and he currently does not see,
the mother left with the children 7 years ago, the children are now 14 and 15 (boy and girl).
my OH suffers from several (mental) health problems and when seperated he did not fill in any csa forms, now what i am wondering is can i write/ring the csa and ask for all communication so i can check everything is in order?
and no before anyone asks we are not looking to stop the payments or anything i just want to check everything over, in the 7 years they have been seperated my OH`s benefits/wages may have gone up/down,
i know were on csa1 and we do have some arrears but paying a set amount each month to get it down,
so could i request all communication?

Look on the sticky links - you want the data protection files from the CSA. They should respond within 40 days, but they can't as they don't have enough staff! As it is law, perhaps the more people who complain the more they will do about it.0

Has this been officially diagnosed by a doctor? If so then he does not have any CSA liability. Section 3 of the Mental Capacity Act 2005.
You must contact a solicitor straight away and get power of attorney.
Also contact the Public Guardian: http://www.publicguardian.gov.uk/utility/contact.htm0 -
Did he claim incapacity benefit at the time? If not, you will find it pretty difficult to claim that now.0

hiya,
yes this is thur a doctor (im not calling him mental even tho most men are lol )
he see`s a phyciatrist (sorry sp) regularly and his gp,
can you help more as im new to this?
kelloggs36 : yes he does claim incapacity benefit, does that mean anything?
thank you all0 -
I meant did he claim it at the time? If not then it is too late to claim that he was mentally ill at the time. If he claims it now and gets incap then he would pay the bare minimum amount if anything at all. Usually it is the flat rate.0

hiya,
yes he has claimed it for several years, (since before he split with his ex-wife)
isnt the incapacity thing only on csa2, where if you are claiming incapacity benefit for csa you pay flat rate of £5?
he is on csa1 where incapacity benefit doesnt matter,0 -

Assessments are usually only re-done (after the first one) at the request of either parent. There is certainly a delay in getting data files from the csa, so it may be worthwhile checking your OH's paperwork to see if the amount he is currently paying is relevant to his earnings.0 -
