CCA request - Barclaycard can't find account (even though they refunded charges!!!!!)

Hi

I need some help here.
The 12/2 CCA request for receipt of the agreement for a Barclaycard (Monument Visa) card (opened in 2004) came and went like winter into spring.
Then, lo ho ho, a letter from Barclaycard's Northampton Customer Services Unit arrived saying ''they had looked into my complaint" (as they call it), "were sorry" to hear about it" but, alas, "couldn't locate the account".

HOWEVER - odd - they have already refunded charges from this card some one month earlier, even attaching a list of the charges refunded.

Info:

The card was "sold" to Cabot.
Cabot told me nicely the CCA had to come from Barclaycard and even posted their address in Northampton to me.
Amount owing: £3000 (have set up d/d with Cabot.)

Do you think this is a genuine error on Barclaycard's part, or an attempt to avoid the request?

Anyone else had a similar situation?

Many thanks
SW

  • Do you think this is a genuine error on Barclaycard's part, or an attempt to avoid the request?

The cynical side, having dealt with them myself, would be to say 'do they do anything without a reason/is it a genuine mistake or a deliberate one?'.

As you probably already know, what a load of cabbages and kings they are telling you. Another delaying tactic and attempt to sidestep their legal obligations. They purchased the debt, so should have the paperwork and at least a Deed of Assignment. The debt no longer legally belongs to Barclaycard for example.

Sure others here will be along with more constructive advice pretty soon.

Not sure tbh. But I requested CCA's from both BC and Monument and what I received was totally shocking from both companies. Monument clearly had a "standard" stored on Word that they printed off with my surname spelt incorrectly!

BC just sent me a very poor "snapshot" of an application form and were incredibly slow to send me even that - nearly 3 months!

Seems they don't have a very good filing system...

Who did you send the CCA request to?
Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional

Right, this changes things a little. Apart from my reading too many threads at once, that is. :D

Because they are now very clearly in violation/default of that CCA request. And as you may already know they are acting unfairly, violating OFT guidelines by selling to a third party DCA knowing they had done this. But I'd imagine they sold it sharpish because they knew that, so it wasn't their responsbility anymore let the DCA deal with it.

And I agree with Deep in Debt. Apalling record keeping.
