Phone calls

Is there any letters that i can send to stop creditors from phoning. I am in a bit of a hole, no job owe a fair few quid, trying to get it sorted but cannot pay anything at the moment. I live at home with my family and the phone is constantly ringing from 9 in the morning till 8 or 9 at night.

If it was my own place I would not care so much but it is not fair on them.

Have got a claim for job seekers allowance going now but that peanuts and i will need that to get to interviews and to eat.

Its not my phone at the end of the day they have tried saying im not here but it doesn't make any difference.

    I'm not sure, but if they ask to be taken off the telephone list and have everything in writing then your creditors have to do it...dont they???

    I'm not sure what you do want then :confused:

    You can certainly tell them to correspond in writing only and if they continue to ring you can report them for harrassment.

    i would send the creditors who are contacting you by phone a letter quoting the OFT guidelines on debt collection

    see paragraph 2.2.g

    tell them that you only wish to correspond by letter and if they continue to ring you will make a complaint to the Financial Ombudsman.

    Keep a diary of the times and dates when they ring plus you don't have to talk to them, if they have rang once in a day, if they ring back again, whoever picks up the phone can put the phone down on them.

    Sorry that is my bad punctuation and grammar. It meant to say.

    I don't know. That is what I want though.

    Are there any template letters anywhere on the internet that I can send? I am not very good at wording things or writing letters.

    Thanks i will have a look at that stuff from OFT.

    Are there any sample letters? I need something that says something along the lines of please stop phoning my folks place, i cant pay anything at the moment but will as soon as i can.

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    Some of these companies use Automated Dialing (so all their agents are working flat out) which is a pain!!!

    I complained to a couple of creditors and eventually got the calls dropped BUT in the end I went Bankrupt to stop all the calls/hassle!!!

    There is a line between them being entitled to pursue debts and harassing (what difference does a day make?)

    I dont really want to go down the bankruptcy route, it is about 15k in total so while it is a fairly large amount, if i can get a job again paying even 1000 a month after tax then i can happily pay £500 a month off these debts so should be able to clear them in a reasonable time frame.

    I did have something lined up so was all set to go on the debt management plan with cccs but then the job fell through so i couldnt do that, im now at the stage where I have missed 2 monthly payments on most of my agreements.

    Appointment with the job centre monday to start claiming and get help finding work so fingers crossed something comes of that.
