CSA with regards to Debt

Hi all. The Wife and I have been having problems for a while now. What actually happens when we split and have to arrange CSA payments. Do they take into account the Debt we both have from our marriage?
Basically We both have £38000 debt and paying that each month will not leave me with anything after CSA aswell.

Depends whether your soon to be ex is in receipt of income support. Then the CSA will have to become involved.
The CSA will not take the debt into consideration.
If your ex is not in receipt of IS you could come to a private arrangement.
I have taken some time responding to your post and was going to post a few ideas, but decided against it.
Have you checked the CSA calculator via their website? It will give you a rough indication of what you should pay.0 -

That's not the case anymore, the rules changed oct last year. The parent with care or non resident parent can now choose whether to use the agency.
They've set up child maintenace options for people who wish do avoid the agency and set up private arrangements.

The column from 27th Oct 2008 states:
Parents with care are able to keep up to £20 a week of any child maintenance paid before it affects the amount of benefit they may receive.0 -
Yes, they have to declare any maintenance payments to the benefit office, and they are are legally entitled to keep their first £20.00 a week.
However, regarding their CSA case, they are classed as a 'private client' and can now close their case at anytime if they wish it. If there is secretary of state arrears outstanding prior to OCT 08, the agency will still collect that though.0 -

If you can keep it amicable and come to an agreement over the debt payments in lieu of CSM or similar then you can keep it that way.
CSA doesn't have to get involved but if she wants them to then they will (nothing you can do about it) however there is a variation ground for prior debts but it depends what they were for originally and how they were run up. (CC's aren't allowed, mortgages and loans are)Nothing to see here :beer:0 -
Basically the debts have been run up using normal bank accounts over the lst 6years that we were married but were then transfered onto 0% CC's. The CC's have never been used apart from the BT's.:oCurrent Debt £38,000:o

Sorry, as Cozworth said, Credit Card debts would not be considered.0

If you are having problems with debt, either of you, i know an excellent website that will explain everything and lead you in the right direction,however i don't think i am allowed to put the sites name or address, does anyone know of a place on here where you are allowed to put links?
