lloyds tsb..im now complaining to fsa...

i havent been on here in a while as my DMP with CCCS has been running for nearly 2 yrs... Lloyds TSB however are a complete pain in the butt...
i have an O/D and a loan with them on my DMP and they wont accept the payment from CCCS direct.
CCCS pay my payment into my lloyds O/D account and the lloyds loan get their share through a D/D set up... i have asked to cancel the DD so CCCs can pay them direct, but ohhhhh no that would be toooooo easy, plus then they couldnt just take out random payments when they pleased making me go over the O/D limit mounting up yet more charges and interest!!!! (they have done this twice!!!
ARGHHHHHHHHHHHHHHHHHHHHH im at my witts end with this shower of asses!!!
it happened last September they charged me for going over my O/D then they took away the O/D charging me un planned O/D i complained and they sent a letter saying they would agree to not charge interest for a further 6 months ENDING MARCH 30th 2009, if my circumstances hadnt changed to write let them know..

I wrote Feb 2009 informing them my circumstances havent changed and would they please accept like the rest of my creditors...
this morning i recieved a letter from them saying i dont have a repayment plan in place and they will continue to take payments til i have!!! Grrrrrrrrrr i have a letter stating i have until the 30th of march!!!

i checked my lloyds account and they took 3 payments one of £43.78 on 20th of feb...(thats what CCS are paying them)
one of £179.87 on the 24th of Feb and £89.40 on March 2nd!!!!!!:confused:

now my O/D has shot back up to over a grand!!!!

i rang CCCS and the girl wasnt really enthousiastic to be honest.. but she give me the number of the FSA and said complain...this is my first complant to the FSA but i did officially complain to lloyds last Sept about the treatment i have been recieving from them... i was being passed from pillar to post with them giving me an O/D then taking it off and me getting charged then saying get CCCS to ring them and they would deal with them, but lloyds WONT deal with anyone over the phone who isnt the account holder..i was being fobbed off...
i have mental health problems and they are making my health suffer even more and yes they are aware of my mental health.. and still they send letters saying someone will come to the house, go to my place of work!! (errr good luck with that!!!), and simply wont accept im on a DMP...

ive got letters thank god i kept them..with dates and the last one says they repayment plan is in place until March 30th, yet they have taken out 3 payments they shouldnt from feb24th!!!

the FSA was lovely, she said she would send me out a complaints form and to get my evidence together.... im just wondering what will happen with my account... i cant bear the thought of going to court.. when i think of what the government has just given them to get out of their mess, yet they wont accept my DMP!!! its not like im not wanting to pay what i owe... i dont own a house and my mental health worker has advised me to go bankrupt as it is really effecting my health, but i dont want to do that, i am taking responsibility for my debt!!! under CCCS it should be paid off in 5 yrs!!

i just had to get that off my chest!!!! has anyone else went to the FSA and if so what happened?????

    Pauline, cancel the DD, and give the a/c details to CCCS.

    CCCS will pay your pro rota payments into that account, and ask CCCS to notify Lloyds once again, they're managing your debts.

    i have tried to cancel the D/D but as its set up on a lloyds account and its a Lloyds loan they just keep re instating it or refuse to let me cancel it (its in the small print of your account terms and conditions apparently!!...

    i wish i had the money to clear my O/D and then close the account, but im thinking until they get the loan money they wouldnt close the account... My O/D is never gonna go down coz they keep adding extra payments to it so just when ive payed off £300 they take extra payment and it shoots back up!!! it is really getting me down!!

    CCCS have said lloyds are one of the worst creditors to deal with!! ive got letters from them saying they are gonna send people to my house and telling me there is a repayment plan until March 30th yet they take 3 extra payment out in Feb!!!..
    so the FSA i hope will fine them BIG as they are breaking FSA rules also they seem to deney ive informed them about CCCS yet another letter states they have heard from CCCS!! it is seriously effecting my health!!! i dont sleep! im scared to go out or answer the phone..although to be honest since of officially complained to them and said i was being harrassed 5 phone calls on average a week, i said take my number out of their data base and they have!!...
    i just wonder because of all the messing me about will i get some sort of compensation..i/e wiping out the £2000 i owe them!! ( yeah like thats gonna happen!! but i can dream!) to be honest i'd settle for them to accept my DMP... they have caused me so much grief when every one else has been understanding... they arent even my biggest creditor yet they think they should get priority it seems!!

    I'll ring CCCS again see if i get any joy as to what to do about the D/D..

    I thought that they had to cancel a DD on request. Will try to look into that a little later.
    Did you cancel the DD over the phone or in writing?

    Good lick with this Pauline. It definately isn't good when they're contradicting their own letters.

    Hi George,
    i had cancelled it over the internet but because its a loan with them they can re instate it, but CCCS told me this morning to write to them and ask why they set up a variable D/D when they knew i was on an DMP... and for them to cancel it immediately and send me out new forms to set up one for a payment of £53.45... when i said to CCCS i wish i could pay off my O/D then close the account, they said even if that was possible (its not) lloyds wouldnt allow me to close the account whilst the loan with them was not paid off.. so they do it so they can take what they want when they want!!! they are no better than sharks!!! im now waiting for them to remove the O/D facility and charge me yet again!!! i know they will... They are parasites!!!

    I am putting alot of hope in the FSA to stop this company who has just been bailed out by the government (that boils my blood!!!) from not showing compassion when i am trying my best to pay off my debt.
    the proper loan payment was for £89, im paying them £53 so its more than half!!!... i dont own my home and my car is 5yrs old i have nothing of much worth to be honest... i got behind with my payment because of ill health i took out the loan originally for a car that is lucky to be worth 2 grand now... ... so going bankrupt would mean they got diddly squat as they are not my main creditor!! ive been advised by 2 mental health workers and my doctor this would be my best solution health wise...but i dont shy away from my debts... i am willing to pay it off...its not like the DMP is for a stupid length of time..it will be over in 5 yrs their loan part would be paid off in 2 1/2 yrs!!

    The worst thing about it is..i worked for lloyds TSB and had a nervous breakdown through bullying in the workplace... i find it hard to cope with people now..i shop on line i rarely leave my house..they did this too me and now they are coming back to finish me off it seems!!!

    Friday the 13th...it sums it up!!!!

    Have you tried reclaiming bank charges and credit card charges (also for the loan)? You should be able to claim back 6 years worth.

    Hi George,
    i had never had charges on my account until i went on my DMP.. i addressed the situation as soon as i knew i couldnt pay... they charged me 6 months ago when they withdrew my O/D after 25yrs... making me £900 O/D and then charging me unplanned O/D charge of £15 a day... i complained and it was sorted..or so i thought!!

    it moved on last night...i got a call from somebody clark and michell.. they represent Lloyds.... i spoke with them and they were quite reasonable over the phone.. maybe coz i told them i was in the process of dealing with the FSA... the bloke said it was a computer error that had took the extra payments and said all the trouble had been caused coz i still had a live D/D:confused: ..
    i explained i had been told from lloyds they needed this to be live so they could receive payments from CCCS... he said i had to cancel it imediately.. (like you said!!). i asked couldnt he do it and he said no...but he told me to do it over the internet..and low and behold it let me cancel it!!!!

    ive also written to some dept in Andover telling them i was told to cancel it by their in house solicitors...(or higher power collections dept is what they really are).. he said for him to repay the money back into my O/D account would take weeks, and really it didnt matter that they took it as the money has just gone towards a debt with lloyds.. i just now owe less on my loan and more on my O/D.

    the thing that worries me is my O/D limit reduces every month and now that it is back up to what is the limit, if they reduce it im gonna be charged!!!

    I guess im gonna have to put all this worry into the letter and send a copy to the FSA, so if they start with their messing me about, i can do something about it...

    the guy i spoke to from their in house solicitor told me through the D/D guarentee, everyone has the right to cancel a D/D and if anyone gave me hassle, i had to point it out!! (he said this after i told him a dept of lloyds told me it had to stay in place and if i had any problem cancelling it to get them to ring his dept!! he also didnt think i could cancel it over the internet, but thankfully i could)..

    it hasnt helped me sleep though...but he has said the £53.45 CCCS are paying them is now gonna be the new payment...but my question is, for how long? i bet in 5 months time it all starts again!! i really hope the FSA can step in and make them stop with the un nessesary pressure they cause and the constant refusal to deal with CCCS..

    I would confirm the cancellation in writing to Lloyds - especially as you cancelled over the internet before and they just put it back on. Possibly worth mentioning the DD guarantee as suggested when informing them you do not wish to have any DD's on the account.

    Have CCCS been able to get them to stop interest and charges? It may be worth pointing this out to Lloyds if CCCS have requested it or if it has been agreed but they are ignoring it.

    I would also let CCCS know what has been going on so that they have a record of it incase there is anything they can do from their end to get them to behave. I would suggest you don't deal with this stuff over th phone - you need a paper trail so that you can prove what has been said and by who.
