Possible Doctored CCA from M&S Money

Hello,I requested a True CCA from M&S Money and recieved this, see below.
I think it is not totally above board. On the first page it has a list of charges that would be applied to the account, I.E late payment.

But all the charges are for £12, but in 2006 when this CCA was signed the charges were definatly not at a rate of £12.

    How are you sure sure they were definitely not £12? You seem very certain of the fact, so I would guess that you have some evidence of this, so you have answered your question about the "fake" CCA. Job done.
  • Disregarding the £12 fees for a moment; they look okay, because that is the minimum default fees been around for a while now. However, ignoring all that, but the key issue I think you need to address is whether this agreement is enforceable? I quickly glanced through it but it would need someone to read it thoroughly and it's a poor copy, not easy to read. There are also possible instances of whether or not both parts belong to each other, as these appear to be separate pages? And having a very doctored CCA in my possession, shown to at least dozens of other people with 'the knowledge' and all agreed the same, soon as I opened the envelope noticed a few things shall we say. I know why you are questioning it. Don't think I do not. ;)

    Probably nothing but I note the printed date bottom of page 1 is not the same as the date stamp, page 2? You'd need to clarify whether that would be the date of issue or the date when it was signed? I take notice of the smaller minutae for example. Anything that looks out of place shall we say.

    But the date on page 1 is 12 December which is probably when it was printed - then if it was posted out and signed by the customer on 15 December - posted back and signed by the company on 18 December. That would seem quite plausible to me.
  • I got 2 credit cards in 2006 and their default fees were £12... so it might be right.
