Aktiv Capital + other CCJs

Hi everyone,
I have posted on this board a few times and I have found some brilliant advice on here.
I am dealing with a family member's debt at the moment. I seem to get lumbered with dealing with all my family's legal and money problems.
Said family member has 5 CCJs. Total debt is around 13k. Capquest have not sent back the CCA within 12 + 2 days and therefore if this is unenforceable, it is around a 10k debt.
CCJs total 3800. I have contacted one company who have 3 of the CCJs plus one other debt. They are owed around 4800 but will accept 2900. I offered 25% and I was put on hold at Aktiv Capital a number of times before he came back and said if said family member could offer 30% then he could speak to his manager.
I called back today with a view to agreeing 30% - they denied this was in the conversation. I asked for the conversation to be listened to. Manager came on and said I had offered 30%. That was not true. I have asked for the whole conversation to be listened to and requested a call back as I am not happy with being accused of saying something I have not.
The manager has duly said he will listen to the call and telephone me tomorrow. I have requested the telephone call - 10 quid apparently. I am not sure who to report such blatent lies to.
Anyway - that aside - they are calling back re whether to accept 1500. What are the chances? This is the first person I am negotiating with.
The other 2 CCJs - family member does not know what they relate to so I have got them to call the court tomorrow and ask.
I am finding it difficult dealing with this negotiation. Is there anything I should be doing that I am not?
Thank you in advance - it's becoming a bit of a weight on my shoulders at the moment.

Best advice i can give you is to do everything in writing, don't negotiate full and final offers on the telephone.
There have been lots of people who have agreed a settlement on the phone, paid it over the phone by card and then received further demands for the rest of the money with denials of an agreement to settle.
To be honest, although you are doing something wonderful for your relative, they would be better to go through CAB or someone like CCCS. Simply because they will know all the best routes to resolution, it's a lovely thing to want to help but sorting out debts is really stressful.Total debt at LB Moment (Nov 2007) = £6583 £4649 20.03.09
£5060 Black horse Loan - £4114 as of 20.03.09
£940 o/d with hsbc - -£535 as of 20.03.090 -
Thank you - I agree about asking CCCS. They called but there was a 3-4 week wait for a counsellor.
I do think I am just going to end up saying to wait for a counsellor as I am getting annoyed at the slime at these places.
I have said that if they accept the 1500 then it will be paid as soon as there has been written confirmation of the same. They wanted my name, the person who the money was coming from etc - I said no, they would not be having my full name or anyone else's for that matter as we will end up getting harrassed as well. I gave them my number to call back on but said if I get any unwanted calls I will change the number and report them.
It's a DCA which is why I offered 25% and have now gone up to 30%.0 -

Your experience has confirmed why it's never a good idea to phone these muppets.
The other reason, the muppets you call work in a call centre, there sole purpose is to get what they can out of debtors, they work to very strick targets, oh, and neither do they have the authority to accept "Offers"
Lesson learned, keep everything in writing only.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

Hi there,
I'm afraid I have no real advice, just wanted to say your are doing a fantastic thing for your relative but don't let it get you down, I found the CCCS to be very helpful. I also had to wait a couple of weeks but they gave me a reference that I could forward on to everyone who needed it after my initial consultation. You could also recommend NationalDebt Line to your relative, they dealt with a very upset me on a number of occassions and were always helpful and gave excellent advice.
Good luck with it and please try not to let it get to you.:hello:  Hoping to be down to Loan Only by Christmas:j Getting there! :T0 -
If I put something in writing who will deal with it?0
