Another what age does maintenance stop?

I am the NRP paying for directly to my ex for my daughter to attend non-Higher Education. She is 19 at the moment and in her first year, she took a year out. Twenty years of age in January 2010.

I have read on these forums that CM stops when the child is 19, however my ex is still receiving CB and hence is entitled to CM.

Can anybody shed any light when CM stops?

    An NRP should cease to be liable when the child reaches the age of 19, although you will pay for one more month after their 19th birthday because maintenance paid via CSA is paid up to one month in arreas.
    There is talk of the age limit being raised to 20 in the future, to come into line with child benefit but that is not the case at the moment.

  • Child maintenance, currently, is payable whilst the child is in further education, so until age 19, and providing that Child Benefit is being paid. Child benefit stops the first week in September after 19th birthday hence Child support shoul also cease then but if there are arrears these will be sought independantly of your liability ending.
    Under CMEC this is set to rise until the "child" is age 20.:cool: in my own opinion, no longer a "child" but note this brings it in line with Scottish laws of maintenance, whereby Liable parent spay until the "child " is 20.

    No, once the child is 19, child support liability via the CSA stops then. It does not carry on until the next September.
    It only carries on until the end of the academic year if the child's course finishes whilst they are still under 19.
    As you say, changes are forthcoming under the pending CMEC rule changes. However, as far as I'm aware these changes are not yet set in stone & they may yet be some time away before they're fully implemented.

    I am still confused by the cut-off point. My daughter is 19 (Jan 09) and my ex is still receiving CB, the CSA have also confirmed that she is entitled to further payments. I do not mind paying but it would be good to know when it should stop.

    So it is payable until Sept 09?

    If they are 19 this September, then the last payment will be this September. It will not carry on after that. My Son, who's in further education, was 19 on 14th May & my last payment was 16th May; 1 month in arrears.

    Under current rules, your cut off point is in January, when your Daughter was 19.
    My Son, who's still in further education, was 19 in May & my last payment to CSA was 16th May & that's where my liability with the CSA ended.
    The CSA have not yet come into line with child benefit payments although CMEC may do this in future.
    As far as I'm aware, what the CSA have told you is wrong. Did you get this information verbally or in writing? They have a reputation for giving out wrong information over the phone.
