Help/Advice Re a Theft Court Case

    As the debt is for over £750 why can't you apply to have her made bankrupt?

    I think the bailiffs would be another good option. They will clear her out to get that much money, tv, dvd, furniture, everything will go save for her bed. That should frighten her into submission. Letting go may be an option but the satisfaction you will feel from at least not letting her get away with it will be something. If someone does not take a stand then what is to stop her doing it to someone else? I mean 7 CCJ's is impressive!

    Its a shame. You are desperately trying to pay our debts off honestly and she is making your life a misery!:mad:

    Hi

    So you have the three options you mentioned:

    1. Warrant of execution (bailiffs)
    2. Attachment of earnings
    3. Third Party Debt Order

    To that we could add

    4. Charging order (if she owns property)
    5. Statutory Demand ( but it sounds like you're a minor creditor)

    And you could in theory work out which is most effective with an information order.

    But if it is looking like this woman is not working, doesn't own a car, rents, is overdrawn at the bank and has loads of debts, then your Dad is right and you're throwing good money after bad.

    But you know and I know (and I suspect she knows) that bailiffs have no power to force entry. A car owned by her and parked outside would be vulnerable but if it's on HP or owned by a partner then even that can't be taken.

    Thanks i knew there was another couple but they didnt really seem worthy , im so banging my head against the wall. in one sense why should i let her get away with it she clearly feels no guilt and even lied to the police.... so i feel like carrying on then i think why bother shes clearly used to ripping people off..... such is life hey

    Horrid story and I can see why you wake up in a rage after all this time.

    You could go the Bankruptcy route by this will cost you a lot of money.

    As somebody that specialises in providing advice to the public on all matters relating to a bailiff visit, I can't believe that I am actually saying this but the BEST solution would be to transfer your CCJ to a High Court Enforcement Company to enforce. You can only do this if the debt is over £600 which it is.

    There are a few firms around....all of them nasty !!. From experience of one that is more likely to get your money back I would suggest that you contact Sherforce Ltd. ( A google search will find them). The fee to transfer the debt up yo them is very small compared to the debt.

    They pay a personal visit within days !!

    Thank you sweet, it really is leaving me in a quandry and like i said im getting to the point of " sod it let them empty her house and if i only end up with 100 quid then she will feel as if she has lost something" rather than just take of clearly a lot of people/companies!

    I used to suffer from lack of motivation.... now I just can't be arsed.

    This is a good point., she was still getting judgements up until last year... and i think it may have shown up had she been made bankrupt already... well im hoping so as if not the courts have been taking my money for no reason..... hold on.. they have anyway lol
