Response from Bank- Re Charges

well i recived a letter from lloyds for one of the accounts i wrote in about..

rather snotty letter saying the banking is free so tough !!!!!! about charges...

then it states that if i cant run my account within the terms then they will have to consider withdrawing cheque books bank cards ect and overdrafts! or i might wish to consider alternative banking arrangements...

they would like to point out that there isi usually a fee for statements and i will recive them within 3 weeks which they trust is acceptable!


what do i do now!!!

i know about the long thread on here about bank charges but i am reallly unwell and cant concentrate i would be ever so grateful if someone could post what ii need to do in here for me

  • Dchurch24 is the guru on here so I'm sure will be along in a minute. But don't panic!!! It's just their first attempt to stand their ground.

    When I went after the woolwich for £824 their first letter said "no way hosay" and my partner said to just give up. I wrote back to them saying the law was on my side, they had 14 days to cough up or I would go to court.

    In the woolwich's case they caved before they went to court but some banks won't. But it is worth digging your heels in. I take it you are a member of this site because you are concerned about your finances in some way. So then don't let a bank steal your money for nothing!!!! Walking up to an old lady in the street and taking her purse is immoral and illegal. So is taking your money from your bank account when you are in a financial pickle. In my mind both acts are just as criminal and totally taking advantage of someone in a weak position

    through three accounts charges amount to almost 2k

    they sent my statement last week saying they are taking £190 on 1st march which is the best part of my weeks wages!!!!!
    i wont be able to afford my rent!!!!!!

    Do you have another bank account which you could use? Or would you consider applying for a new one?

    They obviously don't appreciate you as a customer and there are much better customer service focussed banks out there,believe it or not!!

    My partner successfully claimed charges back from MBNA yesterday ( :j ) so there is hope! Don't give up until you have got your money back!

    Edited to say; MBNA requested that we close our visa account down with them within the next 30 days as we obviously do not agree to abide by their terms and conditions! We were going to do this anyway but sometimes you just have to be prepared to move if only to get your money back.

    At the moment the legality of the charges is in question. It's possible the banks may lose a court case or be ordered by the OFT to pay people back. If so - great. If not - ......

    In the meantime - the question is up in the air. You now have to decide whether it's worth pursuing your bank for a refund of charges.

    IF you have a big amount of charges owed to you AND you don't mind if the bank pays up but then cancels your overdraft or even closes your account - go ahead.

    to put things straight...

    i have no problem closing my accounts as they have been nothing but hassel...

    the od we have would be covered if i get the monry back eg: nearly 2k on bank charges and only 900 overdraft!

    i want to run an account properly from mow on with no charges but as you can see from my sig i could do with getting back money tht has contributed to my debt!

    i know this can be done and i wont give up without a fight...

    with regards to opening another account not much of an option due to poor credit rating however i have a basic bank account with nationwide and my oh is paid in cash so all i need is an account to recieve my wages...

    Well there you go then!! It's worth going through the process if it would clear your overdraft and give you extra!! You can then continue with an account that stays in credit!

    Hi, what did you put in your first letter to them.

    Did you give them an ultimatium - 7 days to give the money back or else?

    Of did you ask nicely ;-)

    If you ask nicely, then you will get nowhere.

    Come over to the BAG site (https://www.bankactiongroup.com) and post your story there - there will be many people in a simialr position to yourself and will have gone through this already with Lloyds, so they will know their form - so to speak.

    I think that there banks is a shift in the banks patterns at the moment - the intitial press releases that they hoped would 'blow-over' have not done so - so now, some banks are really sticking in the heels and others are just paying up.

    Lloyds do not seem to have a policy on it yet - sometimes they dig, sometimes they roll-over and pant.

    It can be quite stressful, so if you are already unwell, you should take that into consideration. However, I think that it should not be a stressful time if you treat the bank with the contempt that they deserve for doing this.

    In fact, it can be quite fun.

    You say you already have a basic bank account elsewhere - bonus - good news - the only (legal) retaliation (and the legalities of this are being looked at too) is to close your account and try to recover the 'debt'.

    As this was caused by the charges and the charges are in dispute then to pursue you for the money would be a breach of the banking code - sadly, banks don't seem at all bothered about breaching this - and I'm not suprised - I searched the banking code web site and there was lots of information about what would happen if the complaint was not upheld, but NOTHING about what would happen if a complaint WAS upheld.

    It seems yet another public protector is in the banks pocket (like the ombudsman and the IC seem to be so far).

    Anyway, come over to the BAG and post your story in the correct section and you will be suprised at how many people have been through the same and can advise better on Lloyds 'form'.

    If it were Abbey, I could tell you straight away what they would do (although their policy seems to have changed recently too! - I think we have them on the run).
