couple of questions pleease

hi we were goin to file for br end of this month but we have now been offered a house with the council but its not ready untill april, we will then have to wait for housing benefit and council tax benefit to be processed before we know our actuall outgoings so im guessing its going to be approx 2 months before we can go br, im nervous about my creditors in the meantime and what to do? there phoning all the time i inform them of the situation and then they say "well can you pay x amount" and stating it will be passed to a dca shortly if not, whats the worst case scenario? were currently sharing 1 bedroom between the four of us in my parents home and nothing within the property is ours my only income is benefits. n power and littlewoods have passed to a dca the others are with the original creditors.its barclaycard who are the worse for calling im ignoring the phone now because with my anxiety i get overwhelmed and become a mess when they phone. funny thing is barclays rejected my application for the card then sent it out to me anyway.
my husbands arent really doing anything apart from one who did a ccj.
.... second question, ive heard people say that child benefit dla isnt counted towards the income how does this work with the forms and or, if i breakdown where my benefits come from will they just disregard the cb and dla towards the houshold expenses and work it out on the remainder? or should i put "disability related expenses" on the form for the dla as an outgoing?
ive got a list of questions after printing off the form which we will be phoning cccs br line about but just wanted to know if anyone could help with these.
thanks
jen

Hi JG
I don't see why you need to delay br. If your only income is benefits your not going to get a IPA and as you move in to your new home (congratulations by the way, excellent news) you can do a new soa for the OR giving revised amounts. I would have thought your best to stick to your original plan for the end of this month, at least your creditors will be off your backs asap and you will be able to move into your home as stress free as possible.
Child benefit is not included in calculating for a IPA but needs to be listed as income. Sorry I don't know anything about DLA:(

jen,
Hi there.... I agree with jenni in that I don't see that the two issues are related. You can go BR now under your current circumstances and then just change your SOA when other events kick in - the house move (congrats) and benefits.
I had to wait nearly 6 weeks for my OR interview anyway, you might be all done and dusted before your interview actually takes place and just think, you could be all sorted and in your new place with no creditors hounding you...
Don't give yourself more headaches than you need to ....
Good luck

thanks jen ourapplications only been processed couple of weeks ago for council so was very supprised to be offered one allready,my hubby is going br as well but he is working part time, do we have to file at the same time? theres only 1 joint debt with hsbc a £500 overdraft, its just difficult for me because i owe a smaller amount than hiim but across several companies. so i have them all phoning up constanly.
if i do go br this month and then we move next month our bills will go up due to full gas electric paying for landline and so on, but should i just leave it then untill the benefit claims are processed if i wont be getting an ipa anyway? and then hubby file for his at that point?
im a little bit confused on filling out the form, i pay for all the houshold stuff, he pays all the car expenses , csa etc i dont know if can put down a contribution from him on partners income or do i put his full income there?if he contributed to what i pay for household stuff it would leave him with less than £99 spare but i would be left with a higher excess and im concerned when he then filed for br the or would want the contribution from him to the household on mine taken off so they could do an ipa on him. i hope that makes some form of sense0 -
Hiya
There are definate benefits in doing it together where you can afford to do so. You don't need to wait for soa reasons as it can be adjusted as and when need be.
As for you I & E if you can post up your soa's then someone will be able to advise you further on them. If your on benefits you won't get a IPA, you husband is surely unlikely to get one if only working part-time and supporting a family unless on a good income for those hours.
Dont forget that your expenses in your new home will be need to be on your soa. You will be able to get a amount from the council for your rent and council tax and you could ring your water, gas electric etc to get the new 09/10 figures. Looking at other posts there are benefits to going br before the new finiancial year with regard to HB/CTB. We had to wait three weeks for our OR interview so if you were the same you would be all settled in new house by then.

so should i do an soa for us both based on our current living situation? our outgoings here are low compared to when we move as we dont pay rent( my parents are concerned they will be asked about it and think there going to get into trouble) so we just pay some towards the bills and our own food etc. i think he would end up paying an ipa currently but possibly not when we move, i will see if i can do the soa's right and post them if you dont mind having a look, should i do two seperate ones? and do i just put my income on mine his on his? also do i put the full bills on both but just put partners contribution on each soa? thanks0

Whats the date the council have given you for moving in to the property?
Also have you got a court date booked yet?0 -
the council have said the current tenants move out the end of march so should hopefully be by middle of april unless there is any works they need to do to it, havent got a court date booked yet, with both of us going br its a lot of money i think we wont have to pay the court fee but still going to be around £700 for the two of us, i think its going to take us a little bit to get that money together, especially as were going to have to get this new hosue carpeted etc and hire van to move our stuff.0

SOA's you need to do individual ones. The general advice is to on each one put your income and your partners contribution. Your rent council tax etc in full on both. On each one though you need to put your individual costings for personal allowences, i.e your OH may run a car which will need to be put on his, you may pay for things only for you, they go on yours only.
We put down the same amounts on both under the expenses and on income mine was the child tax credit and child benefit, OHs was his wage and the workng tax. We were advised by our OR to do it that way but it seems most do it as above.0 -
Firstly phone your local court to see if they have a appointment or walk in service, book if need be. Have you stopped paying all creditors to raise the money? I would be inclined to put down on your soa the costing accounting for your new home, and put on your petition on the bit for extra information a note saying you are moving into council accomodation (perhaps adding a copy of the letter from the council offering you the property).
As you are moving into council accomodation, it will be all ready to live in bar carpets. But one thing is we were able to move in to ours early as we said we were prepared to do the decorating needed. The council even gave us vouchers for the paint. You could try freecycle for some of the things you may need for the house. Do you have any friends with people carriers that seats come out of or know anyone with a van?0 -
I forgot to say try going on entitledto, it will tell you of the amounts for housing and council tax benefit you may be able to get. Alternatively the council should be able to give you a figure.
