hi all, i have left the paperwork with ts to check and they said i may need a solicitor so i got in touch with a company who specialise in unenforceable agreements they said its very likely on what i have told them that i may have a case and if i do, it will be based on a no win no fee .

Please be careful this doesn't get out of hand. The agreement is 2 months old, and all parties accept that there has been an error on the agreement, with an arrangement in place to put it right.

Automatic unenforceability no longer exists, and I would be surprised if anyone would challenge this on your behalf.

I mentioned referring it to TSO only for the benefit of others who may have fallen victim to the same issue.

Apart from that, what are you looking to acheive? If you are unhappy with the handwritten amendment to the agreement then ask for a completely new one to be drawn up. In the long run, I don't think you will be getting a free car out of this, and if the dealer ends up being challenged over this then he may well emerge the victor, but with no desire to be of any further help to you if the car goes wrong in the future.

P.S. Brock : In my opinion your post which brought about the splendid reduction in the OP's monthly payments is the one of the most useful posts I have seen on MSE for a long time.

Thank you - much appreciated

19.5% seems a blooming high number these days, doesn't it?
