In fact i wouldnt pay your ex it at all, I'd call the solicitors yourself and ask them what you owe them and see if they will let you pay this in installments, I could be wrong but I suspect that if you hand the money over to your ex, the solicitors wont see any of it!!! Also she took a credit card out in your name, which is fraud and you could take her to court for that does she realise, see if she is willing to reduce your payments of £150 to her to £100 till you get back on your feet and inform her that you could take action against the credit card she took out in your name without you knowing, that is an awful thing to do xLife is too short for regrets, wake each day with a new slate and forget those that bring you tears, they're not worth it, but relish those that bring you a smile!

Actually, you can't take her to court for the fraudulent credit card – the fraud is against the credit card company not you as if the fraud is proved they are liable for all the debts on it. So they have to report it to the police, and you can't even get a crime number from the police yourself (which the CC company may tell you, wrongly, that you need before they can do anything about it). Know this from bitter experience...
But if you haven't done so already, speak to the CC company, get it stopped immediately, and get a copy of the credit agreement on which she forged your signature. If it really was forged by her and you want to tackle it, then you need to take it up with the CC company.0 -
I never knew that topbadger, thanks, either way if she took it out in his name and he never knew then surley he should be able to do something about that I would have thought? :-)Life is too short for regrets, wake each day with a new slate and forget those that bring you tears, they're not worth it, but relish those that bring you a smile!

He can, yes, but it involves the CC company first agreeing that it's fraud (and however obvious the forgery may look there's no guarantee they will). If they do, then they will remove his liability for it, and it's then up to them to decide whether to prosecute, for which they would need his cooperation. If they swear black is white it was his signature on the form, there's not a great deal he can do about it.0 -
some great replies there guys thank you.
Malc-thank you i will call them tomorrow on the number you have given
Cuddly 12- the letter came bizarrely to me and not the ex. Strange seeing as she is on electoral role and i am not. She was one dodgy chracter hence why i left her.
I'd like to take the credit card issue further, but what if the signature is mine even though i have not done it? Where do i stand? Plus if i do take it further there is the issue of my kids to think about aged 10 and 7
Top-badger- when i obtained my new mortgage a year ago it was highlighted about a ccj. It was for around £300. I know i hadnt took it out along with another at £1800 and i told Halifax that it was my ex. They took what i said as true, which it is and i was lucky enough to have a mortgage at 4.99%
Thing is now, the CC at £300 i have heard nothing about since being ccjd 3 years ago. The one at 1800 is just defaulted but interestingly enough have suddenly come to me after 2 years and again something i knew nothing about.
Do i simply ignore the letter for the CC????0 -
Malc-Thank you thank you thanky ou
Explained the issue to e-on. They will let me pay £39 a month as they agreed it was a half error on their par. £9 of this goes towards the arrears of BOTH gas and electric and they will review in 3 months time.
Thanks for your help.
Aside of all that, Halifax OFFERED me a olive branch in that i can pay £268 month LESS than contracted payments to help us out for 2 months. After 2 months I have to pay just £40 more than contract payments over next year.
Parents in law lending us £1200 to pay Council tax arrears.
Virgin lowered to £14 instead of £35
All HP letters sent out to companies in the hope they will accepts £10 month.
Fingers crossed that I can get back on track eh.
Just like to say thanks to veryone for their input.0 -
