Help, I have previously posted re DH case with CSA, he has child aged 18 who is in FE (6th form), there was some dispute that he was actually attending but a couple of calls to CB and tax credits seem to have got said child into his studies again, so much, that said "child" is thinking of continuing with more studying at University in September (he will then be 19). My heart is sinking because he has told my MIL that his Mother can still claim maintenance from us until he is 21! Surely the CSA can't keep raising the age, the only info I can find is that CMEC is looking to up age to 20, when do the intend to make that happen?? I thought 19 was the cut off for CSA. We have been phased onto CSA 2 last year and they assured by 19th birthday all finished. Can anyone advise please?

But, what if it is classed as Further Ed not Higher? I'm panicking now that they (mother and child) are both clued up enough to play for more money, he seemed to know his stuff!! What if CB is continued to 20 do we still have to pay CSA??0 -
Please dont fret - 19years (at the moment) is the absolute cut off for CSA regardless of what he does.0

This is only rumour and hearsay but I'm sure I've read that there are two law cases out there where a university student has had a claim against the NRP for costs while they are at university?
No child maintenance will be due though.

This has happened and is allowed by the childrens act i believe. But the claim must be from the "child" and not the PWC. It is also very rare and can only be done in court.0 -
I have a daughter just about finishing uni. Her father paid maintenance until she was 19 as she was on a non-advanced course - an Art Foundation course. When she went to university I wanted to claim a means tested grant for her as my income was low however they take into account my partner's income Her father is out of the picture. I think this is wrong but that is the way it is. So whether I have been with my new partner (not husband but makes no matter) since she was little or got together while she had already started university his income is taken into account. By the way he was until recently paying maintenance for his own 18 yr old. But this is also relevant to this thread too. This boy was at college but we think he has left. Partner has stopped maintenance as we want proof he still attending, mother says he is and is contacting CSA. This boy will be 19 by end of year. We shall wait and see! I have been checking CSA site but was not sure about when it can stop but seems it must be 190

If they are clued up though as OP suggests, they will know this and the child will have 'enough' in the account to qualify for legal aid.0
