URGENT advice needed about a charging order on property

    I understand, like I said, when you attend court on Thursday inform the judge you're disputing the charges.

    One issue to consider, the judge may ask why you've not mentioned this earlier (have an answer ready ;) )

    do I go away and then come back with the break down
    The judge should give the claimants a timescale to issue a breakdown of charges, then a new hearing date will be set

    It is certainly possible that this will happen. So much depends upon the judge. He could decide that the hearing is to do with a charging order on an already existing CCJ. and not consider any application to set judgement aside at this hearing. In this case the OP should make an application to set judgement aside.

    i think you are pushing your luck to gete it set aside thats what the first court apperience is for.
    with regard to monthly payments the judge doesnt set these i was with payplan and thay set it and the other side agreed

    I tried to make an appointment at the job centre and was fobbed off with a telephone number. I rang and explained that I was out of work and had received a small amount of redundancy. I explained it was only the equivalent of one months wage. He said I wouldn't be able to claim. Turned out I could and should have.

    Yes, I have extreme anxiety (panic attacks, cant sleep etc) and depression. I am recieving medical help and probably more importantly trying to get all the debts sorted. Last week I spent an entire afternoon opening all the unopened mail. :eek:

    Sorry to hear how tough things are for you, hope it all starts looking a bit brighter soon. Lots of us have been in your shoes (medical or financial or both) so keep posting for support. :beer: I am not sure how the courts work, but you can get normal debt collectors to back off if you are 'vulnerable' - your medical conditions, if you can get written proof from your GP, may be able to be used in your favour. :T

    Also are you in receipt of Incapacity Benefits or Jobseekers Allowance now? The phone number wasn't a fobbing off, that's the system now. It may work in your favour as they should have a record of your contact, as long as you gave some basic info (e.g. name and area). I am pretty sure that's the first stuff they ask for. If you have been misinformed you might be able to get some money backdated. :confused:
