FT to PT after Maternity? What can I get?

I intend to go back to work in June after taking my 9 months off for Maternity Leave. I was employed FT previous to my leave and paid commission. I want to know whether my company has to take me back PT and - more importantly - whether or not they are obliged to pay me the same hourly rate as I was on FT? I was on a salary and commission before and I know that I will forfeit commission. Are they allowed to end my FT contract and employ me on a new PT contract? I ve worked there FT for 7 years. Anyone any ideas?

    They don't have to take you back part time at all.

    They just ahve a duty to consider it and if it doesn't fit the needs of the service or organisation, they can decline it. THey can offer you another role part time if they feel your current role wouldn't work unless fulltime, but don't have to offer anything if they say no.

    If they take you part time in the same role, you will be on pro rata pay & conditions such as commission, a/l and carers' leave. Would you be prepared to accept a lesser paid part time role?

  • Where I work they have said if I decide to go back on a different amount of time then they will start a brand new contract for me...
    Just be wary that they can change terms and conditions if they want:rolleyes:

    Speak to ACAS and maybe to a solicitor.

    I feel like I am being really naive here, but surely if you are losing the commision, which you seem to think is fine, you should be expecting to receive the same wage pro rata.

    This seems to be definite discrimination. In my dept I have two colleagues who work part-time/ reduced hours and they are paid the same as they would be if they worked full time. Isn't that just normal?
