RBS - What are they playing at and what should I do

We have 3 debts with RBS..

1 - Loan circa 12k
2 - Curr Acc - somewhere between 4 and 5k!
3 - credit card - £900 ish

In dec, I was sent a letter asking for £17k in 14 days and stating issue of default. I then spoke to a chap who said the debt was being passed to Irwin Mitchell solicitors for recovery.

Jan, still nothing, so continued to pay CCCS who appear to have paid natwest

Phoned in feb and was told paperwork issues had occured, and whilst in transit no interest would be added. Was also told I could not get a balance over the phone, but could request one in writing.

Phoned again last week, and they still dont seem to know whats going on, but suggested Irwin mitchell will be in touch this week!

Just joined this credit report thingy with experian to see if that sheds any light.

The loan is showing as 2 months late, and there is an outstanding balance, although its not clear when they last received money or reduced balance..! AND there is no sign of the current account at all

  • In all honesty, i would refer this back to cccs. I think it is sometimes a while before they do get in touch and it will be up to them to accept your offer of payment on a DMP.

    This will take a bit to sort out and re the credit check, sometimes they are a month or two behind updating.
    If you are worried i would post on the ask a cccs counsellor a question on the sticky at the top of the board.

    cccs view is that they have always paid natwest (rbs)and until such time as i have written confirmation the debt is moved on they will continue to do so....

    they have advised me to ask for a list of all interest and charges and sent me a template

    That's a good idea. A breakdown of charges would be something you could do for all your debts. Get them claimed back and it will reduce your overall debt. Have you any PPI insurance which may have been mis sold? Could be something else to look into.

  • no ppi - but good thinking!

    JUST bought credit expert with experian....nothing, not a sign of the debt to rbs or irwin mitchell or anyone for that matter

    perhaps they are letting me off :)
  • getting nowhere with this - no response to my 2 letters to Natwest
  • and just checked credit report on experian, again not alot of progress.....

    the loan defaulted is not defaulted and is showing as 2 missed payments, with the balance hardly gone down from what they told me I owed in Ddec - yet I have been told that interest on loans is front ended, so as I have paid over 800 £ - in fact over £1000 if u include aprils I am worried my money is going missing

    the cvurrent account still isnt showing on the credit expert file

    cccs keep insisting payments made be made to Natwest until I have it in writing they have passed the debt on

    i am at a loss what to do next

    any advice please

    From what you state above, it appears the account has gone for litigation.

    Do you have the default notice?

    Have you been issued with a termination letter?

    If yes to both / either of the above questions, can you scan the them up here or PM me for viewing?

    sorry for delay replying

    I spoke to Natwest on Thursday, and they confirm the figures for each account, and confirmed that they were receiving payments from CCCS for each account, and the amounts of them

    Unfortunately the current account is having interest charged at £75 a month - (no charges!), hence balance reducing very slowly. They send annual statments (as per BBA guidelines) and thought I was a freak when i asked if I could have monhtly

    Anyway - the lady said there is a problem with the computer which means Irwin mitchell havent got the files yet, BUT she would phone me back. That was Thursday am....i will ring again Monday

    To answer your questions, i dont have a default npotice or any letters abaout litigation

    CCCS say I should ask for all the interest back, and then complain to the ombusman and see what they say.....
