*** Dla New Claim For My Son But They Can't Get School Report, What Happens Now??***

Hi A few weeks ago I put a DLA claim form in for my 5 year old son who has severe ADHD. I rang them 2 weeks ago to make sure they had all the information they needed and they said they were waiting for the school report to come back. They said they had sent 2 reminders but still heard nothing and the cut off date (for the school report) was 4th March.
Well I rang them back this morning and they said that they did not recieve anything back from the school so they cut it off on 4th March and have now sent my claim back to the decision maker.
Does this mean that they will not try to get a report from school at all now? I had trouble with the school before when my doctor sent them 2 questionaires which they 'didn't recieve' so I ended up having to ask the doctor to send me the questionairre and I took it in to school then sent it back to him for them!
Anyway t looks like the school yet again 'didn't recieve' the DLA letter requesting the report.
What will happen now it is back with the decision maker? And how long will it take do you think? Will he/she contact anyone else?
It has been just over 5 weeks since they recieved my claim form.

    It can take up to 12 weeks for a decision re dla. If they don't have a school report then they will base their decision on the information on the dla application form and the info supplied by your gp. A school report is not always essential.

    If you are successful, your claim will be backdated to either the date you rang for the application form or if you didn't ring for a claim form then the date they received it.

    If you are awarded but not happy with the level of the award or if you are refused its best to ask for a written statement of reasons and at the same time, ask for your claim to be looked at again.

    If they still don't award then you will be looking at an appeal. Your local cab or local authority welfare rights service can help with an appeal. If this fails, then you can go to tribunal.

    I would chase it all the way.

  • If you keep having problems with the school on these issues then make an appt. to see the head teacher and discuss it with him/her,if you are still unhappy contact the chairman of the governors,after that the LEA
