I submitted a defence on the 9th February this year through the moneyclaim site in respect to a claim made against my wife by restons on behalf of MBNA , since then haven't heard a thing - how long does it tend to take until we hear from the court?

It takes several weeks, the court have to write to the claimant with your offer / defence, then the claimant writes back to the court who in turn write to you.
For peace of mind, call the court tomorrow to confirm your defence has not gone "missing"Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
Hi climing.........ss
They have 28 days to respond to your defence. They are allowed a further 5 days for postage. Then if the 33 days falls on a weekend they are allowed until the monday. After this the case is automatically stayed.
BUT! as per usual this is not set in stone. If the judge agrees, the response can be submitted after this for free or they can pay a fee and have the stay lifted at anytime until the case is struck off.
I have recently had this happen, I sent a letter in (to arrive the day their 35 days were up)asking the courts to use it's powers under CPR to stike out the case. There is a delay at northampton and before my letter could be actioned they had paid to have the stay lifted.
Not cricket is it, but unfortunately thats how it works
