12+2 letter follow up for cca requests please help

Sorry to ask this as I know its been asked for a thousand times before but can anyone show me where the 12 + 2 days letter is for a follow up for a cca request. I cca mbna on the 21/02/09 and have not been provided with one, what they have sent me is a nasty default notice and said if I dont pay up in full they will terminate my account and MAY take me to court. Its them now in default isnt it ?Can not find this letter for the life of me, any help or advice most welcome

If you had sent the £1 fee required with the CCA request, then by not fulfilling their obligations with that request, they are in default. The 12+2 day letter is not required but is worth sending to make them aware of what their obligations are and that you are aware of your rights. yes I sent the pound with the original request on 21/02/09. i have proof that they received it on 23/02/09, i believe they have till tomorrow with the 12 working days to produce one but have the letter all printed out ready to send.i was paying them a reduced amount on a self managed dmp regulary but they obviously ainy happy with the amount so I have no alternative but to use this route0
