Phone insurance kept charging me.... help?

    I was looking into getting a phone and in the small print it mentions insurance. It is included in the purchase and was free for the first month, but if you no longer wanted it you had to cancel within the first month or you would be charged monthly.

    But this was the other week. That may or may not have been included on the contract you signed 6 years ago.

    I would have thought when you cancelled the phone, that should have cancelled everything. Whoever you spoke to should have checked, in my opinion!!!

    well they have offered me no such deal as of yet but i imagine they will they are calling me back at 2pm today.

    If they offer me that deal I will tell them I will be expecting the full amount back from the time i canceled the contract as I was not informed that I needed to cancel the contract separately. failing that I would push my luck if i could afford it and take the cash if i needed it. depends on your situation.

    I was informed they do NOT have the paperwork and also informed they have no evidence i never wanted to cancel it. there for i will have been misinformed if they state otherwise.

    Means they have no paperwork to say you ever agreed to have the insurance in the first place doesnt it?!!!

    Surely, while they are taking money out of your account, they would have to hold all the information about your account, including any agreements signed by you!!

    What if changes came into force, they would have to check your original agreement to see if they applied to you or not!!! :confused:

    OK quick update. I droped in to a phones4u store today and depending on when you signed up and what system they wee using you would have have one of the following.

    More recently, only you get a copy of the contract and a copy is scanned and sent to head office.

    Older cases were manual, in which case the document would have been archived at head office.

    I called up there customer services on 0844 871 2231 and asked them to bring up my details, I personally don't exist on that system. I asked the girl on the phone nicely not to put my info on the new system and she agreed. I can only be located on the in store software.

    ring up and find out if you are even on the system. if you are not then politely end the call. then based on that make a judgment.

    They did offer to try to locate the original document and send it out to me but she said theirs no guarentee they would even have documents that old.

    also unless you sign an agreement not to I think you can still claim the rest of the charges if they do not send you out a copy of the documents within 42 days. thats how the DPA works. I would get confirmation on this before you take my word on it.

    F**K YEAH!
    423.47 (i had one month on top by mistake) will be deposited back in to my account within a maximum of 10 days, that's 53 repayments!

    They told me because of the age of my policy they do NOT have the paperwork and were willing to carry on investigating to see if the full £551.31 should be refunded in case I never had signed up. but i bit there hand off and accepted the £423.47.


    I am pretty much broke atm and with bank charges and bills coming out this month I would lose most of the £127.53 difference so it didn't seem worth the hassle.

    Sure I also lost the interest but either way its a win in my book. Wish you all the best with your claim
    baggybond ill keep checking this thread over the next few days in case I can help you out. I was also not asked to sign anything or agree not to carry on investigating the issue in the future so i technically could carry on but I don't think I will.
