    I personally would rather there was a copy of the agreement. Then I could challenge the loan in a far more robust way where the lender could not wriggle and twist and get out of paying or can still harm the borrower. At least I could then prove my case. And I make no apologies for doing so.

    There was a brief interview on TV a few weeks back with the guy who wrote all this up. He said everything he put in it was put there deliberately to protect the consumer and if the company was stupid enough not to ensure everything was carried out correctly then they only have themselves to blame if an agreement is not correctly executed or is lost.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    so as well as a loan being unenforceable if the bank has lost the credit agreement can you also claim back PPI on the loan on top of that.

    Bank have sent their final letter stating they have lost agreement and I gave 8 weeks to yake matters further (complained to ombudsman), but they have told me over the phone over £4000 has been added to this loan for PPI.

    If you SARN the lender I am sure there will be evidence amongst the stuff they send you that will prove that you have PPI included, Agreement or no agreement.

  • Hey, I have been told that my Card company no longer has my application. I dont think Im paying PPI, the statements dont show it but are you saying that it can be "claimed" anyway..? I am uncertain of the actual situation so do they need to cough up (so to speak) cos they cant prove otherwise?

    No not at all. You would have to have PPI within your agreement to be able to claim it.
    Usually when you sarn, evidence of the PPI's existance shows up somewhere even if there is no physical agreement.

  • AH ok, great. I have also heard (sounding a bit money grabbing now but still..) that some people are entitled to their payments being compensated. What situation warrents that? Is that a lost agreement scenario too or something more damaging?

    You are now into the realms of unenforceable agreements. Much harder to win such a case and you would have to get your agreement checked out by a professional.
    there are plenty of companies out there that offer this sort of service for a fee. There will be plenty of takers who will request that you hand over your hard earned cash if that is the route you wish to go.

    It also all depends when you took out the card.
