Data Protection Advice

Hi All,

I wonder if anyone has any experience with the following.

I was having one of my many battles with the people at MBNA recently and I discovered that after I had asked - no TOLD them to remove my mobile number from their records as it was a business phone - and I am not giving them permission to use it. This in itself took many attempts - back in January,

Since then I have now found out they have not removed my mobile phone number - and I am now receiving phone calls from a third party acting on behalf of MBNA. I called MBNA to complain - and the girl said that she could see that request for my number to be removed on their system but clearly they have not actioned it.

So my question(s) are -

What do I do?

Is this illegal under data protection act?

What can I do about it?

    I'm confident it's a breach of the Data Protection Act - there are eight key points that staff are trained on and one of those points is that as the, hmm, 'owner' of your own details you have the right to demand amendments to their information held about you.

    Obviously if you said "Wipe my entire record" they might not be too obliging as they'd still want to communicate with you, but a simple request to remove a mobile phone number because it's a business number should have been actioned at the earliest possible convenience. Again, there's not a specific time-related rule with the amendments but it is expected that it should be done as soon as possible, not when they feel like it.

    Here is some useful information if you're able to find the time to read it.

    Unfortunately I don't know exactly what legal route you can take but I stand firm that if you ask for an amendment (and no, it does not have to be in writing) then they are obliged to make it for you.

    Hopefully someone more knowledgable in the other areas will be able to assist you in this matter!

  • Thanks for the reply - I have completed a online complaint form through a goverment website....lets see what happens.

    It makes my blood boil that these companies do this......and WE have to take time out of our lives to get it done correctly..........

    I have a similar situation.
    Egg kept calling my home phone number at all times during the day when I was at work. When I got home I would contact them by secure message or post only and ask them to stop calling me.
    Because they weren't getting a response by phone they did some type of trace on my address and got the phone number of my elderly grandmother who lives in our house but has a separate phone number. She does not have the same name as me so there is no way they could have done a trace on my name and address.
    They then started harrassing my Grandmother.
    I explained the situation and asked them to take the number off the account. They said they would do so but every now and then they still call the number. I have tried to get them to explain how they got the number but they can't tell me, they just say it is on my account.
    Does anyone know how they could have got this number and what I can do to stop them doing it again?
