Debt Letter

Hello, everyone, this is my first post on the site, and was just wondering if anyone could give me any help/advice. I appreciate that this topic has been dicussed before and i have read the threads but just wanted some further advice.
My wife recieved a letter from TELOGRAM acting on behlaf of CAPQUEST saying there is an outstanding debt. The leeter came to her parents address and they had not spelt her surname correctly. However she contacted them and they said that there was an otustanding debt of £107 to Littlewoods. My wife had no recollection of this, and did not give her details, address etc, although they do now have our phone number and try to ring reugularly and will now probably be able to locate the address and send some big burly blokes around!!!
CAPQUEST say that the debt is from July 2001, and when told that this is over 6 years old and there is no legal requirement to pay the debt, she stated that they had been passed the file to deal with in May 2007 and had been making attempts to contact her since then (conveniantly just befor the 6 year deadline). However this letter which is the first to the wrong address and name arrived only yesterday (6th March 09). So she stated that if we were claiming statute bar then WE had to prove that they had not been trying to contact us. Is this the case or not? Not sure what to do or where to look for advice.
I have confirmed with Littlewoods that my wife did have an account althougth they could not tell me when the last payment was made on the account because their records did not go back that far, only that the account was there from June/July 2001. Stupid thing my wife has a current account with Littlewoods with the same details and they never said anything!
Any help would be gratefully appreciated.

Crapquest specialise in buying unenforceable debt and in making uop the most ludicrous rules which have little semblance with the law.

Debt collector are often threatened but have no more legal power then the paperboy. In practice they very very rarely turn up and if they did tell them to leave.

I see a training need here as the Crapquest staffer knows less about the law than a basic DFWer.
The law states that if your wife has not nmade payment or acknowledged the debt in writing, then the debt is staute barred (unless there is a CCJ).

Oh dear, more problems. It is for crapquest to prove that the debt is enforceable not for you wife to proive otherwise.

There is a good chance they will next try to say that you ackowledged the debt on the phone.
1. Telephone calls do not count.
2. Once a debt is statute barred, it remains statute barred, even if the person makes a payment,

Crapquest are one of the unlovely DCas on here. Another has just been forced to make major changes in it practices (similiar to those you are reporting) or will lose its licence. So please report them to the OFT AND THE Trading Standards closest to their office.
I suggest that if they ring you again you refuse to answer the security calls, tell them you have alreadt made a complaint to the Oft because they misled you and are recording the call.If you've have not made a mistake, you've made nothing0 -

My Brother in Law is in the Armed forces and was living in Germany for over 12 years and needed a UK address so my wife let him use ours.
We have recently received a letter from a company called TELOGRAM. It says they are authorized agents for Lloyds TSB and they want to confirm where our Bother in Laws address is.
Today a woman from TELOGRAM rang my wife's mobile, when she answered they said they were from TSB at first, my wife asked them how they got the number and they actually went through the electoral register, could not find our number so they contacted one of neighbors who gave them, silly I know, my wife's mobile number. I rang TELOGRAM today also and they just are not interested that he does not live with us. We are not sure if he has debt with TSB or what. But surely the companies underhand way of obtaining our mobile number is illegal.
I have contacted the TSB who have not heard of this company.0 -
they told our neighbour they had some urgent mail for him0
