T Mobile Harassment

Over the past few weeks I have had bills from T Mobile sent to my address. These bills relate to someone who does not live here but who used to live in a block of flats up the road and mistakenly used our postcode. The amounts owed have steadily got higher until today when it reached over £1200 - including a termination penalty. I have done everything I can to stop these bills. I have phoned T Mobile many times explaining the postcode situation and giving them the correct address. But they totally ignored everything. The latest minion I spoke to assured me I would receive no more bills. A couple of weeks ago I got a letter from a debt collector in Glasgow threatening action. I have written to T Mobile customer service on several occasions and also informed the debt collector of the mistake but today is the final straw. This amounts to harassment. I am in fear of leaving the house empty in case the bailiffs come round. Has anyone any suggestions please? I am at my wits end

Lets clear up the difference between bailiffs and debt collectors first, although the DCA would rather you thought they are the same.

Debt collectors have no legal power. They are often threatened and if you are dealing with the like of Lowell, Mackenzie hall etc, this is quite likely, but they very very rarely turn up. Precisely becasue the DCa know that they have no right to even talk to you and that you can call the police to remove them.

In order to send bailiffs, the DCA has to go through a lengthy court procedure. Even then, the bailiff has no right to enter the property and no right to take anything that does not belong to the debtor.

However, I would suggest that you write to them again, and tell them the correct post code.

I assume these letters are addressed to the debtor not to you?

(I have written to the debt collector and many times to T Mobile giving the correct postcode. The debtor has since moved)

    (Yes)

I should add that in addition to T Mobile, we have also had to deal with gas, electricity, council tax and a summons regarding unpaid court fines for this individual as well as countless other organisations including benefits payouts. It's been a nightmare. T Mobile are the only ones ignoring everything.

    Thank you for your reply.

    Ok

As long as the leters are cvoming to him at your address,

    either

put the right post code on them and pop them back in the post box

or write return to sender on the letter and pop it in the post box.

Even if the bailiff were to turn up, they do not break in and as soon as they discover the wrong address, they will leave.

Did all that but they kept on coming and coming.

The letters I sent back marked "not at this address " or return to sender.. Some organisations kept writing back.

I am still recieving mail for the old man who died in this house 13 years ago, despite telling them repeatedly.

It is their problem not yours. If you do not feel like re-posting then letters just bin them.

You are letting this get to you and there is nothing to get you.

As RAS says, ignore these letters and get on with your life. These people can't do anything to you other than wind you up with these letters and, well, the best way to deal with that is to choose not to open the letters and not to worry about the contents.

Some businesses just can't be told, and frankly these are not worth worrying about.

Just to let everyone know that Fraud Assurance from T-Mobile have now been in touch apologising for the account being opened at my address without permission.
The account has been cancelled and, very importantly, we will not get a bad credit rating with the credit reference agencies because of the account. Possibly if I had just ignored the letters, things would have got a damn site worse.
They thanked me for telling them about it as it would help to combat fraud in future.
So thanks to all who helped on here. Very much appreciated.
