Brother unless I've misread. What you have said is, he is on the mortgage but the house aint worth more than is owed on it. She should see a Solicitor. Get the separation documented and the house valued at the time. Get it noted that she alone is now paying the mortgage. Keep a copy of all payment receipts.
Im not a lawyer so as i say visiting one is the first port of call.0 -
Thanks, Hearts. She has visited a solicitor and she was advised initially to get the house valued etc, to see if any equity was available in the property to be settled. There isn't any so a letter has been sent accordingly advising her ex that there is no money in the property. He is refusing to come off the mortgage after only being on the mortgage and deeds since May 08. Has paid nothing and will continue to pay nothing yet he was to hang about and wait for it to make money.
What if the roof collapses or othe major renovation work needs to be carried out. He won't be about to contribute to those sort of costs so why should he be able to benefit from an asset he is paying nothing towards.
Gawd, it's sooooooooo frustrating.0
