employer not paying me my wages

hi guys posting this on here with the hope that someone can offer me some advice.

my husband started a new job on feb 2nd, it didn,t work out as he questioned things they were asking him to do, the work conditions and the fact he wasn,t getting a break at all. nearly 2 weeks into the job he had a todo with one of the bosses. he told them he wern,t happy they told him to get his stuff and f off. he was told he would get paid at the end of feb by cheque.
anyways, end of feb no cheque in the post so we called them and was told they would sort it but had done nothing as they didn,t have his tax/n i details . we popped in on mon and they hadn,t done anything about it. called them twice this week to be told they will sort it when they get round to it.
what do we do now? its money he is owed

    Do you have any sort of proof that he worked there? Did he have any contract etc given to him? You could write them a dated letter stating what has happened etc and that you look forward to recieveing his pay due by xxx date - it's usually practice to give them 1 month. State in the letter that if monies owed are not recieved by the date specifiedyou will be taking them to the small claims court. Send this written letter by recorded delivery and also keep a copy for yourself, keep the recorded (signed for) delivery reciept and when you check on royal mail and see delivery is confirmed print this out also.

    If they do not respond you can take them to the small claims court - this is around a £60 fee, maybe £70 now. If you are on benefits i'm not sure if this can be waivered.

    For more specific advice it mmight be best to phone the CAB or make an appointment/ go to a drop in centre.

    My OH had this problem over not being paid correctly and making promises to pay but they kept missing their own specified payment date and the letter did the trick and they paid up.

    Hiya., clicked wrong button at first..sometimes im dangerous with a keyboard lol.

    Im not totally sure about the best way to go, but it sounds like they are bad employers. have you tried ringing ACAS for advice.

    Next stop would be CAB - although its is really busy, but i went to my local cab yesterday and they have a new gateway system where you turn up and get seen for a 10 min chat first so worth a try.

    Only other thing i can think of is threaten to take them to the small claims court

    what sort of business was it? was your husband ever in a union?

  • My daughter has a similar problem; she is a student at University in Scotland and is owned payment of wages from her former employer.

    The employer has failed to reply to either her letters or to a letter from the Students Union.

    The amount owed is not huge, but every penny counts when you are a student.

    The Small Claims court might be an option - but can the fee be waived for students? Otherwise it's not worth her while.

    Aside from ACAS is there any other body that would deal with Employers obligations?

    We don't live in the UK, so not very au fait with the regulations.

    Assuming you win your case the fee will be added to whatever the former employer is ordered to pay.

    when i had this it was enough that ACAS had got in touch with the employer to get the money from them
