  • Thanks for the advice, Its good to know that someone has had trouble with Halifax before. I too was getting loads of phone calls and they too suggested to me about borrowing from friends and family. He also said "Oh look you have money in your current account" and my reply was "yes and I have to live!!!" I have since opened another account with a different bank and I am now getting my wages etc paid into that. The man who i spoke to was so heartless - I definately couldnt do that job and sleep soundly at night.... when i spoke to them yesterday they said that they would pass debt on to the debt collector - so hopefully they will be more understanding.

    Hope someone can give me advice, I have a unsecured loan from the Halifax £18000, i should be paying them £398 a month, but due to fnancial difficulties this just isn't possible. I have contacted them on several occassions and sent them financial statements. Even though I am offering to pay them £60 they are saying this isn't enough and I received a default notice today saying that if i dont pay the arrears of £1300 they will take it further and it could end in baliffs coming round or me being taken to court. I explained my situation to them but they are just not listening, They also mentioned "attachment of earning" . I am really worried that even tho I am offering something each month (i am still paying £60 per month) that they are going to take it further and I could end up losing my house. Can anyone advise me on this matter.

    The truth is that they can do all the things they are saying to you and probably will given half the chance. So lets ,look at what they can do for now. I love how they mention bailiffs before they actually start any action at all. They would have to take you to court first and then the judge would issue an order telling you how much you had to pay. As long as you paid that amount ordered by the court then the lender could do no more to you.

  • thanks, Im guessing that when the court see's your incoming and outgoings that they will make a decision based on that, and not what the creditor wants to be paid. I should be paying £398 per month but I am paying £60 per month, Halifax are saying this isn't enough . I can see their point but surely something is better than nothing. And as I keep telling them this is a temporary mesure.. At the end of the month I am left with £250 to pay my creditors (All but the Halifax have agreed to lower payments and are happy at the mo). Could the court say pay all the £250 to Halifax or will they take into account my other creditors.
