I just posted about this very thing. You can sue your bank for unfair treatment regardless of their terms and conditions, and judging by their treatment of you this would definitely seem grossly unfair!
Thanks Ali, it was a horrible time. I can't tell you how relieved I am to be rid of them. I wouldn't even know where to start with the unfair treatment route and I'm probably not in a position financially to do so. I'll just be glad if I get my remaining charges back from the ombusdman - at least then they haven't profited from it all.0 -

It's an absolute disgrace that Banks can treat us with utter contempt and quite literally ruin lives! The law I referred to does give us the power to make them accountable, it's through the County Court and doesn't cost a lot to bring a case for unfair treatment. If enough of us can, and are in a position to, bring cases then we can finally put a stop to anymore of us poor badly treated customers suffering at the hands of these unscrupulous profit driven corporations! Glad your life is back on track :-D0 -
The BCOBS came into force in 2009. They are hugely powerful regulations and are capable of being used to force banks to act fairly in relation to their customers in every respect.

We have been in debt and started using payplan a year ago.
We were told at the time to move from Lloyds (due to our Lloyds debt) so we went to Halifax and they confirmed that Lloyds would not use the offset rule and were still separate banks etc.
Today, payplan told me that they were now merging and the offset rule will take place with my old Lloyds account merging with the new Halifax, and to get another bank account as quickly as possible.
I have googled the 2 banks to see if there is any news on them merging (was told it took place at the end of 2012) and nothing. Just old news dating 2009 ish.
Does anyone know about these 2 banks becoming one?0 -
A few months ago my daughter's partner successfully reclaimed PPI of approx £900. However as he was paying off credit card debt he was told it would be taken to offset this. Months later it still has not been taken off debt nor is it in his account . Despite numerous costly phone calls and letters, plus a lot of stress the money is WHERE??? earning interest for natwest I'm sure, but not benefitting him. Any suggestions what to do next gratefully received please.0

After taking Martin's advice I made a claim for PPI against all the accounts both myself and my partner held with Nat West. A few came back unresolved but then at the beginning of this week I received a letter saying PPI was going to be paid against an okld load £899.00 I was elated until I read the small print. I took out a DMP with Step Change last August on the advice of Nat West, due to the DMP Nat West have informed me that the money will be offset against my debts. I am still struggling to pay my monthly bills which I have explained to "the friendly bank" ha ha.... they have initially agreed to pay the interest only, which I suppose is better than nothing. Seems so wrong that they can miss sell something to you, refund the money, and still tell you how to spend it! Will the same thing happen when I get rthe miss sold PPI against my credit card? or can I ask if the interest on that can be paid direct to me?0

It is usual that with a PPI reclaim that it is used to repay any outstanding debt from that creditor.
You can try asking for it to be paid by direct, and point out that you are in financial difficulties hence the DMP, but they may not agree.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Still looking for a definitive answer with regard to setting off across Lloyds and HBOS. I contacted the FSA about it and even they said it was a grey area. More confused than ever now.0

hi guys. quick question: does anyone know if Halifax takes the offset payments from bank accounts on a specific day (e.g. the first of the month) or does it just happen as soon as any cash appears in the bank account?
more info for anyone thats interested: I have a cc and bank account with Halifax and my cc is in arrears and I can't afford to pay it off right now. they have already taken some money from my bank account so I've emptied it as I need all the money I can get.
My problem is that I will have more money getting transferred into the halifax bank account soon so i need to know if Halifax will take it immediately it appears in the account or will I have a few days to withdraw the money from an ATM?
