Help with Capquest

Hi
I was hoping someone may be able to help me out. I have been trying to get debt free for nearly 18 months now. I was in a DMP with CCCS but found that I was still getting hassled by companies all the time and as my debts were getting sold on it was taking a while to update information with the CCCS and I was getting a lot of hassle.
Stupidly about 4 months ago I decided that I would run my DMP myself as all my creditors were dealing direct with me anyway and I was still having to send them SOAs anyway. This has been going OK for the past 3 months and strangely the calls and letters have died down since the creditors have been dealing with me directly and I have direct debits set up with them. However I have had problems dealing with 3 companies.
Capital One have just sold my debt to Cabot so I will have to wait to see what Cabot say.
Two companies are chasing me for the same Natwest debt (I have been paying one for the last 18 months so not sure where the other has come from). i am waiting to hear back on the CCA request.
But the one that is really bothering me is a letter from CapQuest. Until recently I was paying off my Halifax debt with Wescot services through my DMP. However I noticed on my DMP statement that CCCS had stopped paying them last year. I thought that the debt had been sold on so wasn't surprised when I got a letter from Cap Quest about the debt. However they have requested the amount in full (£1200). I sent a letter to capquest explaining that I had been on a DMP and paying Wescot. I recieved a letter saying that unless I pay in full before March 9th then I will be served a statutory demand. I called Capquest this morning to say I was not in a position to pay this and they said that they would take £900. I said I was in a DMP because I don't have this kind of money and he suggested I sell my car. I don't own my car outright and it has more finance on it than it is worth though. He then said that if I didn't pay in full by March 9th then it would go to court and I would be made bankrupt. Again I asked if I could pay in installments and he was adament - all or nothing! I pointed out that this was ridiculous as I am not hiding from my debt and I am willing to pay, I just can't pay at once. His reply was you signed the credit agreement it is your problem.
Can anyone please tell me how I can sort this as I am really working at reducing my debts. I was £15000 in debt and am now £9000. I don't want all the hard work over the past 18 months to go to waste because of this.
Please help.

Hey Pinks
Firstly dont stress, easier said than done I know! I am with Payplan and my Egg debt was sold to Capquest, intially they were awful to deal with and threatened the same things as they are to you. I did explain that if they made me bankrupt they wouldnt get the money back at all, whereas if they let me set a DMP with them they would get all the money back, however over a longer period
Next thing I know they have accepted the payment proposal for 2 years which shocked even me. Even though I am with Payplan I find that I am doing alot of the contact with the creditors, but it is nice to say well I am working with Payplan.
I am not suggesting you go with Payplan, but just stick to your guns and they will back down. If it does end up going to court I cant see a judge looking favourably with them as you are wanting to pay the debt back anyway!
Good luck tiger!0 -

http://www.oft.gov.uk/news/press/2009/20-09 as 1st credit are being boolocked by the OFT for making the same sort of threats.
You might want to make a formal complaint to Crapquest detailing your experience and include a copy of the document linked above.
Please report them to the OFT, if they continue to fall foul of OFT guidelinesIf you've have not made a mistake, you've made nothing0 -
As others have saids don't panic. Of course they want all of their money!!!
Firstly write to them and ask them for a copy iof the signed CCA. I bet you they don't have one. that puts the debt in dispute.
Secondly do you have any charges you could claim back from Capital One?
Cap 1 passed my debt to Capquest and i ended up asking Cap 1 for all the charges back which was the value of the debt.
Had to go through the ombudsman but got what i wanted and told capquest to bog off.

Thanks everyone. It is just so frightening to be sent a letter like that but I suppose that is what they are hoping and are preying on vulnerable people.
I will write a letter today to them and see where I get with that. The thing that was worrying me was that I only have a week to act in before they send the stat. demand.
It is good to know others have gone through similar and come out of the other side.
Does anyone know what the likelihood is of them issuing a statutory demand if I have asked to pay in installments?
Thanks again.0 -
they can't have what you haven't got - they all try the bullying tactics. Funnily enough I have 2 companies also chasing me for the same Natwest debt - 1 of them is capquest!
I am also doing my own DMP I find it much easier as I know exactly where I am with each creditor, once you get into the swing of it it is easy - you will find occasionally that although you are paying one DCA another will pop up as they sell it on - if you didn't get a deed of assignment - make sure you ask for one along with a CCA request. (it might also be prudent to ask the orignal DCA aswell - I rang capuest when Apex started chasing us Capquest told me to tell them where to go.0 -

Hi, I recieved a letter from capquest today threatening me with court action for a debt i owe to Next Directory, the only problem i have with this is that i have never purchased anything from there. Is this a scam or just a mistake? What do I do?
Cheers

Hi
They will have just sent the letter to everyone with the same name.
You could just ignore them unless they do start court action.
Note it almost certainly say may start court action. 1st credut have got into trouble for the same type of antic. Hopefully crapquest will be just behind them in the stocks. If you've have not made a mistake, you've made nothing0
