Just a quick question.

Requested DP File back in Sept 08 from DP Unit at Longbenton, Newcastle. CSA did not provide the file within 40 day legal requirement and in fact it was well over a month late.

When we did receive the DP file it was found to be incomplete, no telephone transcripts as requested, no Departure applications, but most importantly none of our bank statements included. (CSA Criminal Compliance used these to incorrectly assess our case, taking earnings as all monies except my wife's wage - even tax credits, child benefit etc - we are fighting this)

So, wrote to DP Unit at Newcastle and asked that they provide the 'missing' parts of the file within 14 days. Received letter back from them confirming file incomplete, and that on this occassion they had slightly exceeded their target (thought it was a legal requirement - not a CSA target!!), and that they also state they would get back onto Falkirk, who were responsible for sending information to DP Unit for checking in first place. Now been over a month still not heard anything, so reported them to ICO.

But, just a query, we strongly suspect that Falkirk have misplaced the bank statements that they are incorrectly assessing us with, in fact we have been told this by 2 different CSA Reps over the phone. We are currently appealling against the CSA decision with regard to 'earnings' and obviously our bank statements are of paramount importance to the whole case. CSA state that a 2nd CSA Officer checked our income/assessment late in 2008, and agreed with the 1st CSA person, so this is why we are going to appeal - BUT how on Earth can someone check the bank statements if they can't even find them - seems a bit too convenient to us.

Don't know how we can progress this so that they either come up with statements, or just admit they've lost them, obvioulsy we have copies, but that's not the point, their total incompetence is just unbelieveable. Also, we have had 2 letters saying appeal can't be accepted, as we are out of time, but they even had dates on the letter stating that appeal is in fact in time, so hubs rang up and yes even more mistakes - crazy

    not got much in way of advice m8, but totally sympathise with you, my case at Falkirk office also, total waste of space, the lot of them

    Think he was a bit sick of us, in fact no, he was a lot sick of us just before Christmas when we enrolled him to assist us with other ongoing CSA issues.

    In real terms, he hasn't done a thing, except put certain questions regarding our case to Complaints Team, who keep giving us and him standard responses, but will try him again.

    How would we progress with regard to internally complaining about this, as ICO now involved and our case now a 'high profile complaint case anyway', but just wondering if we should approach for maladministration financial redress, just thought they may listen a bit more if they think they may have to pay us ' isn't it normally £50?' - it's not about the money, it's the principal!

    We just expect a certain service and at no point are we getting it - to the disadvantage of all parties involved in this case NRP, NRPP, PWC, and all children to include step-children involved
