AJ, I am not trying to score points with my posts, just making people aware of the rules.
If CMC's want to operate based on their 'interpretation' of the rules then that's their business. I personally would not recommend that approach, and I am sure most would agree with my sentiment.0 -
It is all about interpretation though, law is all about what is reasonable - there is hardly a law in this country that is complex but hard and fast.
Like I say, these firms are operating within the rules, but what is the true meaning of referal, association, claims firm etc....
I dont think there are big firms ignoring the rules, I think to understand the guidelines and rules and run a business, you gotta know the rules with a "businessmans" hat on.

Another example - there is no such thing in Court in England and Wales of No Win, No Fee. It is not allowed.
BUT, it is manufactured as "no win, no fee" by using a conditional fee agreement principle and combining that with an ATE insurance for clients - which amounts to the same result all round.

AJ, you strike me as the type of chap that likes to have the last word, so I'll let you add that after this post and be done with it. I think the posts so far on this little debate we have had speak for themselves.
You have gone from accusing me of being part of the 'PC police' (whoever they are) to actually acknowledging that I am very well informed, so I suppose there has been some progress.

I used a firm that gives:
100% refund is a claim is unsuccesful
Free pre-audit check of your agreement without any obligation to use thier services
No fees to pay at the completion of a claim too which they ALL charge but dont mention or its in the tiny tiny small print - why? If a claim is succesful and all you gotta do is a few grand at the end - there is NO WAY a punter will not find that somehow.... its almost blackmail
I did not know how to do it myself - I mean I knew HOW (the process) but not the specific knowledge of identifying breaches and making a claim etc... and there is so much more to it than claiming PPI back..

I was cold called by a company last week saying theat they could clear any credit card or loan debt I had due to the agreements being in breach of the consumer credit act but only if the agreements were issued to me BEFORE 1st APRIL 2007, they said there was a recent BBC Panorama Program (10th Nov 2008) which had raised awareness of these facts.
They said most agreements before 1st APRIL 2007 are unenforceable and therefore can be written off. They said their solicitors will write to your various debtors (once they have got the account details from you) - from here they let you know whether they can help or not.
Obviously they charge a fee but they say its fully refundable if they cannot clear the debt, & if they can clear the debt their fee is then cleared when the debt is written of anyway. Now obviously I am a little sceptical about this but thought I would do some research first before deciding what to do.
