    The T&Cs of my bank account prohibit post dated cheques too.

    As for it being illegal I think this is stretching the point a bit. It is certainly illegal to write a cheque you have no intention of paying but that is not the intention of post date cheques.

    As has been said though, once the cheque is written the payee is entitled to cash it.
