Child Maintenance Support

Please Help...

My husband has been divorced from his ex for 6 years and has two kids he is still paying child maintenance for (as set out in the divorce agreement) each month he pays cash - yes I know I am worried about the lack of traceability reading other threads - however his son (now 18) has decided to start a college course two weeks before his 18th birthday. His ex is now demanding continued payment as this is classed as full time education??

Can someone please define full time education as some sites you read say college is not included and others say 12hours a week classes full time education.

Does he have to continue paying for these 'random' college courses for the rest of his sons life if he choses to stay on them and do nothing else??

  • What did the original order say? Most will set an age i.e 18 or until the child has left "full time education". Your husband needs to look at the original order.

    Sounds like there is no out... would there be an 'out' if college at the age of 17 was stopped and then not started again until nearly 18??

    Ahh...I quoted you. Perhaps I should have put an exclamation mark and lots of these :rotfl::T:cool:;)

    As it's a court order you may find your husband may have to pay until the "child" leaves full education ie after completing a degree. To quote you " cease full time education or further order.'

    Is there a problem?
  • yes the problem is the following...
    his son went straight from school and started a college course and then shortly after his 17th birthday he stopped going..
    My husband continued to pay on the promise his son was going to rejoin the college in the Sept to continue the original course... (which he didn't start in Sept) so notice was given to the ex that payments would stop on his 18th birthday... to which now my husband's son as decided to do a catering course for 10 or 12 weeks - not sure of the details...

    Can this go on and on?? Was my husband in the wrong to continue paying when we knew his son has thrown in the towel on the first college course??
