Do you take this woman (and the debt)?!

Hi all

Sorry if the thread tittle seems a little harsh, I dont mean it! My Fiancee and I are due to get married in Nov '10, nothing is booked yet however. My fiancee lives with me, I own my own house, and in no debt, apart from the obvious mortage.

Prior to this relationship, my fiancee had a house with her ex. The relationship ended and the house was reposessed. The reposession left a debt of approx £70,000 between them both (The house has already been sold and a final certificate has been issued but have not yet been chased about the debt).

My other half and her ex have no contact now, so we have no idea about his plans.

We are really looking forward to getting married, but know that this needs to be sorted before we get married otherwise it will hinder any future plans we have.

The questions really are:

- who will chase this debt and when will it be chased, can we speed up the process?
- Is bankrupcy an option for my fiancee to clear debts prior to marriage and what will the repercussions be for married life if any?
-Can you get married while in bankrupcy state without affecting the other half?
-Is there any legal process that can be written to keep the dept with my fiancee/wife when married?
-My other half has heard this crazy idea that couples are eligible for a 'same sex' civil ceremony that 'binds; people together but does not has any legal standing. Is this true and has anyone else heard of this, is this an option?
-WHAT THE HELL DO WE DO?!?!?!?!?

I would really apprieciate any advice on this, It is causing us to halt any further advance on the wedding as we both dont want our future and any future of kids we want to have to be affected by this rediculous debt. Please let me know if anymore infomation needs to be provided as we would be grateful for any help!

    sorry cannot help with your bankruptcy question as this might be better posted on the bankruptcy board.

    Same Sex Civil Partnerships are binding and do have legal consequences - it is much harder to get out of a same sex civil partnership than it is for heterosexuals to get divorced.

    all i know is debt can be chased for up to 12 years for shortfalls from a repossesed property. She may be chase by a DCA or the actual lender themselves.

    Same sex civil ceremony is legal and binding AFAIK.

    The other questions I am not sure about. I *think* a bankrupsy is attatched to the person so there should be no kick back on you if you have no joint debt however I have just renewed my home insurance and it asked if any residents had ever been made bankrupt so I would imagine that there may be some implications there.

    Same sex civil aprtnerships are what they say, i.e they are for same sex people. This doesnt fit with you two !

    Your options are dont get married,get married in a registry office, go for the full religious bit in a church/synagogue..whatever.

    Bankruptcies are personal however there could be some fallout on you since she wont be able to get credit for years and she lives with you so there will be other issues.

    I'm reading between the lines here and i think you are wobbling a little!

    Is she normally ok with money? How did all the debt build up?

    Also i think there are issues involved in living in someone elses house. They might not be apparent now but they may become apparent in future !

    Why not get legal advice on a prenuptial agreement stating she's not entitled to anything owned by yourself prior to marriage.

    Marriage wise my friends had an hand fastening which is a pagan wedding - no legal standing but it joins to people as married for a period of time - only one I've heard of!
    Looking for solutions and hoping for a miracle!

    Thank you all so much for your help. Believe me, I am not wobbling! we wrote this post together as we both dont want this debt to be chasing us around.

    The debt was accumulated from a house reposession from her previous relationship, and I have no concerns over her money handling. Is rankrupcy the best option then for my fiancee then? I just dont want our future to be put on hold.
