I need some help please ... problems with HSBC

My head hurts and I've now got "writer's block" :eek:

Here's what I've done so far:

Re: Current Account reference – XXXXXX XXXXX455

I refer to the above matter and to my debt management plan currently with CCCS (ref: XXXXXX).

Upon reviewing the various correspondence received from you, I have to say that I am somewhat confused as to what is going on regarding my account/managed loan.

Your letters of 1 July 2008 quote account details of XXXXXX XXXX455 and state that you agree to the proposed repayment plan with a total balance of £3,720.00.

Your letters of 6 November 2008 quote account details of XXXXXX XXXXX384 and state that you agree to the proposed repayment plan with a total balance of £3,890.00.

Your letter of 10 February 2009 is an arrears notice in relation to a credit agreement numbered XXXXXX XXXXX669 and wherein you state the balance outstanding is £3,629.18.

Your letter of 11 February 2009 (ref: ACT06/LACGEN) makes no reference to ANY account number and demands immediate payment of £3,953.20.

Your letter of 19 February 2009 quotes account reference XXXXXX XXXXX455. I intend to file a formal complaint to the Financial Ombudsman Service, specifically in relation to the alleged “overdraft” on this account. This “overdraft” was put in place by yourselves in or around October 2008 in order to facilitate payments to the managed loan facility and for which you continued to charge me. I never made any request for an overdraft facility and your actions have forced me into further debt.

Congratulations if you have made it this far down the post! Are you following what I'm trying to say/ask/do:confused: because I've got myself confused now :rotfl:

So, can anyone help me say what I'm trying (really poorly) to say.

I need to find out what the correct account number is (hubby still thinks its the 455 number and we have no idea where the other account numbers come from) and the correct figures.

Can we complain about the Bank putting us further into debt by "giving" an overdraft - that hubby never asked for ... we were well into our DMP at the point that they added the overdraft in order take payment for their managed loan and then they've added charges on top of that once "their" overdraft ran out. I'm sure I read somewhere about creditors not being allowed to force you into more debt blah blah ... but my brain has gone numb, I cant think where I've read about it - I found the OFT Guidelines but I dont think they apply to bank accounts/managed loans - just consumer credit agreements?:confused:

I will sort out reclaiming other bank charges separately - but first things first - I need to know what to do/how to sort this out. I've tried contacting CCCS but not getting anywhere. They just keep saying that they will continue to send the reduced payment to them but this sounds like it really isnt going to go quiet any time soon.

We owe more now to HSBC than when we started last June and it is so, so hard to try and stay positive about all of this when you feel like you are just going backwards constantly.

If anyone could offer some help - it would be most appreciated. :o

    You need to send off a SAR letter, the cost is £10.00, they have 40 days to comply, once you receive ALL the information back, you then need to generate a paper trail, if and when you find any "Errors" only then you will be able to seek further assistance, here's the letter to send, oh yes, an SAR request DOES require your signature, once signed enter a couple of xxx accross your signature

    DATA PROTECTION ACT 1998

    SUBJECT ACCESS REQUEST


    Dear Sir/Madam

    Your name: xxxxxx

    Account No/ No’s

    I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts And or credit cards

    Please supply me with a complete list of transaction and charges relating to my history with your organization, INCLUDING Loans and or credit cards, payment protection insurance and other products. Alternatively a complete set of statements for the accounts or associated accounts is acceptable. I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:
    -Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.

    - A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.

    -Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

    -Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.

    - Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

    -Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

    I enclose a cheque in the sum of £10 to cover your fee.

    IF YOU UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROCECTION.
