Egg/default

We're entering into a DMP with CCCS (won't start until May) as as a result of my redundancy & subsequent fall in salary. We have an unsecured loan with Egg & as with all our creditors sent them a token payment for February (and are about to send out the March payment too, we haven't missed any payments before that) with a letter explaining our situation & what we're doing about it (i.e. CCCS reference etc). They cashed the payment but haven't acknowledged the letter in any way (it was sent by recorded delivery).

Egg have emailed us, texted, called home & mobile numbers (all of which we've ignored). We've just prepared the "please communicate only in writing letter" but this afternoon received a letter from them referring to their 'previous correspondence' which was (i) a letter stating that our direct debit payment had been cancelled & we need call them to set up a new direct debit - this was after they'd received our letter & cashed the token payment, then (ii) a second letter simply saying they hadn't received our payment. They went on to say that

- we haven't provided them with a satisfactory payment plan - we haven't given them any payment plan just said that CCCS would contact them when the DMP was set up.
- unless we phone them in the next 48 hours they will 'proceed with their collection procedures which will include the issue of a statutory default notice'

My instinct is to send them the March token payment as planned with our new CCCS letter & the harassment/stop phoning us letter & leave it at that – I have no intention of telephoning them. Am I missing some vital legal point here? Do I need to do anything else?

    Just send them the CCCS letter (the one they tell you to photocopy and send to all your creditors with token payments) with your token payment and leave it at that. CCCS will be contacting them soon. Expect phone calls and letters but just repeat the same old script - " debt management plan through CCCS, regular payments will be made every month, CCCS will be in touch, have a nice day". Don't rise to threats, if in doubt ring CCCS for advice.

    Just keep sending the token payment. Egg did respect the "only in writing" letter to me, but they wrote almost as much as they had previously called. Rarely went more than 3 days without a letter from them!!!

    After 3 months of my DMP Payplan told me they'd accepted my payment plan and apart from the usual default, haven't heard a word from them since.
