Cabbolt Any Info?

Hi, A Company Called Cabbolt Have Contacted Me With Reguards To A Debt Of £5000, My Other Debts Are Being Paid In Instalments So No Probs But This Company Contacted Me And Said They Wanted £500 Per Month Or They Can Consolidate Loan And So On All Seemed Very Dodgy Plus I Wont Do,,,, They Have Left It 3 Weeks Now Contacted Me Again And Said What Am I Going To Do ...any Suggestions And Any Info On This Company? Are They Debt Collectors The Credit Card Debt Was For Monument The Interest Does Seem To Have Stopped If They Are Debt Collectors I Would Rather Go To Court As I Did With Nearly All The Others And Arranged Realistic Payments And Wont Negotiate With Debt Collectors Over The Telephone Hence Why Most Debts Went To Court And I Never Pay Collectors ,so Any Advice

    To answer your question, yes they are debt collectors but they are called Cabot.

    Think your being a bit silly not negotiating with them if it can prevent you from going to court - a bit like cutting off your nose to spite your face.

    My partner has had dealings with them - also for a Monument account, and they have been absolutely fine. Negotiated amounts of repay with them, and they send you a form through after 6 months and you can either have them contact you or just say you can't afford to increase at the moment.

    Why put yourself through the stress of going to court, when you can do all the ground work now and start paying off your debts! Seems a bit pointless really - you are going to have to pay it off eventually!
    Gimme back my bank charges!!!!!

    Don't be tempted to consolidate the loan. You'll only end up in loads more debt and it will cost you more. These people are not there for your well-being, but for their own profits!

    Decide how much you can afford to pay, put it into writing, and tell them you will only deal with it in writing and not over the phone. Keep copies of everything.

    You may be better off going to court and explaining to the judge! There is yet to be a law passed that anyone can get blood out of a stone. If you're sent a summons to go to court, don't be tempted not to go - always go.

    If it's the company Cabot we have had dealings with them in the past, and they were very reasonable to deal wiith, we sent in a SOA (statement of affairs) and agreed a repayment plan with no troubles or hassling phonecalls afterwards.

  • They're debt buyers. So you need to make sure the debt is yours, and that they can prove it. Write to them, using the letter below. Send it by Recorded Delivery and enclose a £1 postal order in payment of the statutory fee.
    I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    You should be aware that the debt probably cost them about 10p in the £. So, anything you pay them over that is pure profit. Make them work for it.

    My partner has delt with these before to do with an old student account and i must admit they were fine.
    In fact she agreed to pay them £20 a month after she paid that for 3 months they sent a letter offering 50% off. We explained that we still could not afford that so we carried on paying them £20 a month and we now keep getting letters from them offering 50% off but still not in the position to do that. is a shame though it would save us over £2500.
    But anyway i would just agree a payment plan with them
